AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR THE PURCHASE OF
COMPUTER El~UIPMENT AND SOFTWARE FOR THE WEST MEMPHIS DISTRICT
COURT, AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated ~ 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHERE~~S, it is necessary to upgrade the existing computer hardware and software in
the West Memph~:> District District Court, and
WHEREAS, the District Court has contacted several suppliers of its computer
equipment and software to provide the upgrade and to make certain the upgraded equipment and
software is compatible with the District Court's existing equipment and software; and
WHEREAS, the current suppplier of computer equipment and software which is under
contract to the Di~;trict Court is better equipped to handle the installation and any problems
between hardware and software; and,
WHEREAS, the current supplier of computer equipment and software would not include
any additional charge for installation and for which the other suppliers would charge; and,
WHERE.hS, it would not be feasible or practical to require competitive bidding to
accomplish the necessary upgrade of the District Court computer equipment and software;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION l . Competitive bidding is hereby waived for the purchase of the computer
equipment and software as set out in F.x;~ibit "A" from Coastline Micro in the amount of
$11,667.00.
