ORDINANCE NO.
AN ORDINANCE PROVIDING FOR THE LEVY OF A ONE-HALF PERCENT
SALES AND USE TAX WITHIN THE CITY OF WEST MEMPHIS,
ARKANSAS, AND PRESCRIBING OTHER MATTERS PERTAINING
THERETO.
WHEREAS, the City Council of the City of West Memphis, Arkansas, (the "City"), has
determined that there is a great need for immediate improvement of municipal services and for a source
of revenue to finance such services; and
WHEREAS, both the West Memphis Public Library and the West Memphis Police Pension
Fund would qualify for state aid if their property millage were raised to a full mill; and
WHEREAS, the General fund could contribute its share of property millage to the West
Memphis Public Library and the West Memphis Police Pension Fund and use receipts from the
additional sales tax to make up any differences; and
WHEREAS, A.C.A. ~ 26-75-301, et seq., (the "Authorizing Legislation"), provides for the levy
of a one-half percent (0.50%) citywide sales and use tax;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS:
SECTION 1. Under the authority of the Authorizing Legislation, there is hereby levied a one-
half percent (0.50%) tax on the gross receipts from the sale at retail within the City of all items which are
subject to the Arkansas Gross Receipts Act of 1941, as amended (A.C.A. § 26-52-101, et seq.), and the
imposition of an excise (or use) tax on the storage, use, distribution or other consumption within the City
of tangible personal property subject to the Arkansas Compensating Tax Act of 1949, as amended,
(A.C.A. § 26-53-101, et seq.), at a rate of one-half percent (0.50%) of the sales price of the property or,
in the case of leases or rentals, of the lease or rental price (collectively, the "Sales and Use Tax"). The
Sales and Use Tax shall be levied and collected only on the first $2,500.00 for each single transaction.

SECTION 2. That the funds collected by this additional one-half percent (0.50%) tax shall be
distributed as follows:
Airport Fund
5.0%
West Memphis Police Department 57.0%
West Memphis Fire Department 38.0%
SECTION 3. That the General portion of the property tax be decreased from 2.0 mills to zero
and that the Library portion of the property tax be increased by 1.4 mills and the Police Pension Fund
portion of the property tax be increased by 0.6 mills.
SECTION 4. That all ordinances and parts of ordinances in conflict here~ith are hereby
repealed to the extent of such conflict.
SECTION 5. That this Ordinance shall not take effect until an election is held on the question
of levying the Sales and Use Tax at which the majority of the electors voting on the question shall have
approved the levy of the Sales and Use Tax.
