2484 ORDINANCE NO. 21'�
AN ORDINANCE TO WAIVE COMPETITIVE BIDDING FOR DECORATIONS TO
BE USED IN WORTHINGTON PARK, MARTIN LUTHER KING PARK& RIDE
AND BIG RIVER CROSSING TRAIL HEAD, APPROVING A CONTRACT
BETWEEN THE CITY OF WEST MEMPHIS AND FESTIVE DESIGNS, INC.,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS,Arkansas Code Annotated Section 14-58-303 allows waiving of competitive
bidding in exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS,there are many items necessary for the City's use where competitive bidding
is deemed not feasible or practical; and
WHEREAS, the City of West Memphis, West Memphis Advertising and Promotion
Commission and Festive Designs, Inc., have submitted a contract for the use, installation and
removal of decorations to be used at Worthington Park, Martin Luther King Park&Ride and Big
River Crossing Trail Head for the 2018 holiday season; and
WHEREAS, it is hereby found and determined that it would not be feasible or practical to
conduct competitive bidding for such services;
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS,ARKANSAS:
1. Competitive bidding be waived for the use, installation and removal of decorations
provided by Festive Designs,Inc.,for the 2018 holiday season. Competitive bidding is being waived
for the reason that the West Memphis Advertising and Promotion Commission has been unable to
locate any other providers for these types of services.
2. The contract between the City of West Memphis and Festive Designs, Inc., for the use,
installation and removal of decorations for the 2018 holiday season at Worthington Park, Martin
Luther King Park&Ride and Big River Crossing Trail Head is hereby approved,and the Mayor and
the City Clerk are hereby authorized to execute said contract on behalf of the City of West Memphis.
3. EMERGENCY CLAUSE. It having been found and determined by the City Council
of the City of West Memphis, Arkansas, that Festive Designs, Inc., is the sole provider for these
types services and 2018 holiday season is fast approaching and time is of the essence,an emergency
is hereby declared to exist, and this Ordinance being necessary for the preservation of the public
peace,health, safety and welfare of the Citizens of West Memphis,Arkansas, shall be in full force
and effect from and after the date of its passage and approval.

The following contract is for decorations to be used at Worthington Park, Martin

season:
C7 LIGHTING TO BE USED IN TREES IN PARK
Service includes installation and removal of C7 lights in all the destignated
trees in the park as well as use of lights and stringers. Price includes
installation and removal -$13,400.00
LIGHTED BALLS & C7 LIGHTING TO BE USED IN BERM TREES IN PARK
Service includes installation and removal of C7 lights in all the berm trees as
well as use of lights and stringers. Service includes installation and removal of
lighted balls in designated trees along the bayou. Price includes installation
and removal -$12,500.00
40' CUT CHRISTMAS TREE IN PARK
Service includes the cost of the tree, installation and removal of C7 lights,
ornaments, and star as well as the use of lights, stringers, ornaments, and star.
Price includes installation and removal of lights, ornaments, and star -
$12,900.00
REPLACE LAMPS ON BAYOU BRIDGE
Service includes cost and installation of bulbs and repairs to stringers as
needed. Price includes installation of bulbs and stringer repairs as needed -
$1,950.00
PREVIOUSLY PURCHASED ANIMATED FIGURES, RIBBON TREE AND SINGING
REINDEER IN WORTHINGTON PARK, MARTIN LUTHER KING PARK & RIDE
AND BIG RIVER CROSSING TRAIL HEAD
Installation, removal, re-furbish as necessary previously purchased animated
figures. Inspect, install and remove ribbon tree and singing reindeer. Report
any damages or outages to ribbon tree and reindeer for remedy by A&P
Commission - $2,900.00
TOTAL COST FOR CONTRACT— $43,650.00
Installation to be complete on or before November 18, 2018
Payment— 50% deposit with contract, 50% due upon installation.

Hi Stephanie,
It's that time of year again. The A & P will be contracting out Christmas lights at Worthington Park
and MLK park and ride. As in the past, we want to use Festive Designs, Inc. We have used them
for many years and they are the only company in the area that does this type work.
Ramona has said she will sponsor an ordinance waiving competitive bidding for this project.
Attached is Festive Designs contract for this year. Is there any more information you need to put
together an ordnance for the Oct. 4th city council meeting?
