ORDINANCE NO. ~-
AN ORDINANCE TO REZONE CERTAIN ZONED PROPERTY
FROM C-3 TO C-5, DECLARING AN EMERGENCY AND
FOR OTHER PURPOSES.
WHEREAS, a petition has been filed with the Planning
Commission of the City of West Memphis, Arkansas, by Chandler G.
,Watkins and Dorothy S. Watkins and Delta Enterprises, Inc., as
provided by Ordinance no. 411 of the City of West Memphis,
Arkansas; and
WHEREAS, a notice was duly published on the 3rd day of

March, 1965, that a hearing would be held by the Planning Com-
mission on the 18th day of March, 1965, at the City Hall for the
purpose of taking action upon said petition and calling upon all
interested parties to appear at such hearing to make known their=
objections, if any, in connection with said application for rezoni:
of property hereinafter described; and
WHEREAS, at said meeting on March l8, 1965, and by the
petition previously made to the Planning Commission, it was
requested that the following property located in Crittenden County
Arkansas, to wit:
A parcel of land lying in the East Half (E2)
of the East Half (E2) of the Southwest Quarter
(5W4) of Section Twelve (12), Township Six
(6) North, Range Eight (8) East, described
as follows: Beginning at a point 2255 feet
South and 20 feet West of the center of Section
12, Township 6 North, Range 8 East, thence
West 410.05 feet, thence South 320.35 feet to
the North right of way line of U. S. Highway
70, thence East 132.38 feet along the l0 00'
(D-1° 00') with an internal angle of 20 20'
(I-2° 20') to the tangent point (P. T.) of the
curve thence south 10 feet along the U. S.
Highway 70 right of way line, thence East
278.20 feet along the North right of way
line to a point on the West line of Avalon
Street, which is 20 feet West of the center
line of Section 12, Township 6 North, Range 8
East, thence North 303.6 feet along the West
line of Avalon Street to the point of
beginning. Containing 2.94 acresm~re or less.

line of Pearce Street, thence South 321.25

the North right of way line of U. S. Highway 70,
thence East 103.25 feet along the North right
of way line to the point of curvature (P. C.) of
a 1° OQ1 curve (D-lo 001) with an internal angle

WHEREAS, no persons appeared to offer a protest against
the rezoning of said property as requested; and
WHEREAS, the Planning Commission recommended to the City
Council that said rezoning be granted.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
WEST MEMPHIS, ARKANSAS:
SECTION I. That the following property located in Crtt-
enden County, Arkansas, to-wit:
A parcel of land lying in the East Half (E2)
of the East Half (E2) of the Southwest Quarter

(6) North, Range Eight (8) East, described
as follows: Beginning at a point 2255 feet

County, Arkansas, and SUBJECT also to right of

drainage canals,
now zoned as C-3, be and the same is hereby rezoned to C-5, Genera:
Commercial District.
SECTION II. All Ordinances or parts of Ordinances in
conflict herewith are hereby repealed.
SECTION: III. Emergency Clause: It is found by the
Council that the present zoning of the above described lands is
not appropiate for proper and orderly development of the City of
West Memphis and, in order to maintain an orderly system of zoning
of districts within the zoning authority of the City of West
Memphis in keeping with a proper city plan for the orderly develop
jment of said area, it is necessary that the rezoning of the above

described property be immediately accomplished, and therefore, an
emergency is found to exist and this ordinance shall be in full
force and effect from and after its passage, approval and publi-
cation as required by law.
SECTION IV. COPY OF ORDINANCE FILED FOR RECORD; A copy
of this ordinancetihen duly certified by the City Clerk, shall be
subject to being filed and recorded in the office of the Circuit
Court Clerk and Ex-Officio Recorder within and for Crittenden
County, Arkansas.
