To date, we have received communication from many cities requesting that we ,prepare and file claims for intervention on their behalf to recover these taxes. On May 24, 2018, Defendants filed a petition with the Arkansas Supreme Court requesting that the Supreme Court halt proceedings in the lower court. The Supreme Court has not yet issued its ruling on Defendants' request, and as the Court is now on its summer recess, a ruling is not expected until mid-September. Defendants have also filed a Notice of Appeal from the lower court's summary judgment decision on May 23, 2018. They are required to file their record or receive an extension of time to file the record by August 21, 2018. In light of the two filings with the Supreme Court, the lower court has extended the deadline for filing of Motions to Intervene until after the Supreme Court rules on the petition and the notice of appeal. It is still timely for your City to participate in a claim for damages as a result of the court's decision in this case. If you wish for us to prepare and file your Motion to Intervene and Claim for damages with the Jefferson County Circuit Court, at no cost to you, please contact us at: Thomas P.
