AN ORDINANCE REQUIRING LICENSURE PURSUANT TO THE
REQUIREMENTS OF ACT 950 OF 1999 FOR THE ISSUANCE OF A
BUILDING PERMIT FOR THE CONSTRUCTION OR REMODELING
OF A RESIDENTIAL DWELLING AND FOR OTHER MATTERS.
WHEREAS, the State of Arkansas requires contractors to provide a copy of such
contractor's Residential Building Contractor's License issued by the Residential Building
Contractors Committee of Arkansas upon application to the Building Inspector for a building
permit for the construction of a single family residential dwelling; and
WHEREAS, the City of West Memphis desires to provide for both the sound
construction and remodeling of residential dwellings within the City of West Memphis and,
therefore, desires to also require residential contractors and remodeling contractors to provide a
copy of such license upon application to the Building Inspector's office for a building permit for
remodeling of a residential dwelling when the cost of the project exceeds twenty thousand dollars
($20,000);
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. Applications to the Building Inspector for the issuance under West
Memphis Municipal Code Section 12.06 of a permit for the construction or remodeling of a
dwelling, consisting of one (1) but not more than four (4) units for residential occupancy, when
the cost of the project is twenty thousand dollars ($20,000) or more, shall include a copy of such
applicant's Residential Building Contractor's License issued by the Residential Building
Contractor's Committee of Arkansas pursuant to Act 950 of 1999 (A.C.A. ~ 17-25-501, et seq. ),
as the same may be amended from time to time, and a statement by such applicant that such

license is in full force and effect.
SECTION 2. A property owner who acts as a residential building contractor for the
purpose of construction or remodeling of his own residence is not required to be licensed under
this ordinance unless the person constructs or remodels more than one (1) residence per calendar
ae year.
~ SECTION 3. The requirements of this ordinance shall be deemed to be independent of

the requirement of any other ordinance for the issuance of permits for such construction or
remodeling.
SECTION 4. Violations of this ordinance shall be punishable as a misdemeanor offense
and shall be punishable by a fine of up to $500.00. Each day that said violation continues shall be
a separate offense and each day subsequent to the first of the violation shall be punishable by a
fine of up to $500.00 per day.
SECTION 5. If any section, sentence, clause or phrase of this ordinance is for any reason
held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions of this ordinance.
