ORDINANCE NO. 500
AN ORDINANCE TO AUTHOR:
RESTROOM FACILITIES AT
PARK WITHOUT NECESSITY
DECLARING AN EMERGENCY
WHEREAS, it has become

Ball Park; and
WHEREAS, it is not feasible to advertise for bids
on such project because of the element of time involved; and
WHEREAS, the estimated cost of said project is
$5,000.00 and the need for same to be constructed without
delay necessitates the waiving of the requirement of competitive
bidding on this particular project;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
WEST MEMPHIS, ARKANSAS:
Section 1. It is hereby determined by the City
Council that competitive bidding is not feasible or practical
on the construction of restrooms for the School Street Ball Park.
Section 2. Competitive bidding on this particular
project is hereby waived pursuant to the provisions contained
in Ark. Stat. 19-4425 (Annotated).
Section 3. The Mayor and Clerk are hereby authorized
and directed to execute a contract for the immediate construc-
t ion of said project .
Section 4. EMERGENCY CLAUSE. It is hereby found and
declared by the City Council that there is an urgent need for
the passage of this ordinance to enable the immediate construction

of the facilities set out herein; therefore, an emergency
is declared to exist and this ordinance shall be in full
force and effect from and after its passage, approval and
publication as provided by law.
