WHEREAS, a petition was duly filed with the City Council of the
City of West Memphis, on January 5, 1956, asking the City Council to vacate
and abandon the following street and alley:
That portion of Gathings Drive which portion extends from the North
line of the right-of-way of U. S. Highway 61 to the North line of Thaanas
Avenue, and lies immediately West of Block 1 of the Wheeler Subdivision to the
City of West Memphis, and immediately East of Block 2 of the Wheeler Sub-
division to the City of West Memphis as shown by a replat of Blocks 2 through
17, Block 21 and the North Half of Block 18 of said Subdivision, prepared by
Bond Engineering Company and recorded in Plat Book 2 at pages 113 and 11I~ of
the records in the office of the Circuit Court Clerk and Ex-Officio Recorder
in and for Crittenden County, Arkansas;
That alley extending from Twenty-fourth Street to the West Side
of Gathings Drive through Block 2 of the Wheeler Subdivision to the City of
West Memphis as shown by a replat of Blocks 1 through 17, Block 21 and the
North Half of Block 18 of said Subdivision, prepared by Bond Engineering
Company and recorded in Plat Book 2 at pages 113 and 1111 of the records in the
office of the Circuit Court Clerk and Ex-Officio Recorder in and for Crittenden
County, Arkansas.
WHEREAS, after due notice as required by law, the Council has, at
the time and place mentioned in the notices, heard all persons desiring to be
heard on the question and has ascertained that the street and alley as herein-
before described have heretofore been dedicated to the public use as streets
afldalleys as herein described, and that said street and alley are unimproved
and have not been actually used by the public generally; that all of the owners
of the property abutting upon the portion of the street and alley to be vacated
have filed with the Council their written consent to such abandonment; and that
public interest and welfare will not be adversely affected by the abandonment
of such street and alley.
NOW, TI~REFOFtE, BE IT ORDAINED By the City Council of the City of
West Memphis, Arkansas;

SECTION I. The City of West Memphis hereby releases, vacates and
abandons all its right, title, together with the right of the public in

corded in Plat Book 2 at pages 113 and 114 of the records in the office of the
Circuit Court Clerk and Ex-Officio Recorder in and for Crittenden County,
Arkansas.
SECTION II. A copy of the Ordinance duly certified by the City Clerk
shall be filed in the office of the Recorder of Crittenden County, Arkansas.
SECTION III. This Ordinance being for the immediate protection of the
public peace, health and safety and in the interest of the public, an emergency
is hereby declared to exist and this ordinance shall be in full force and effect
from and after its passage.

Court Clerk and Ex-Officio Recorder in and for Crittenden County, Arkansas.
The petitioner request that the above described portions of said street
and alley be permanently closed.
A hearing wfll be held at the City Hall in the City of West Memphis,
Arkansas at 3:00 p.m. on I'ebruary 2 , 1956. All persons
having objections to the closing of this street and a12ey are hereby notified to
be present and make known their objections, if any.
