AN ORDINANCE TO VACATE., RELINQUISH AND RELEASE AN
EASEMENT OR RIGHT OF WAY FOR A PART OF 5TH STREET
IN THE. CITY OF WEST MEMPHLS, AND FOR OTHER PURPOSES
WHEREAS, on the 31st day of May, 1957, J. C. Tennison and
J. D. Tennison, Jr, and their wives executed and delivered to the City of
West Memphis their right of way deed granting and conveying unto the City
of West Memphis an easement and right of way for a public street over, upon
and across lands owned by them in the Tennison Industrial Subdivision con-
sisting of a part of Lots 86, 87, 88, 89, 90, 93, 94, 95, 96, 97, and 98 of
the M. P. Horsley Subdivision formerly all of the W., A. Gage Subdivision
except the South 100 feet of Lot 71 as recorded in Plat Book 1, page 218 in
the Office of the Circuit Court Clerk and Ex-Officio Recorder of Crittenden
County, Arkansas, which easement and right of way was located on and within
the boundaries of the following tract in West Memphis, Crittenden County,
Arkansas, to-wit:
Beginning at the Southwest corner of Block 2, Tennison Industrial;
thence North 78°53' East 40' to a point; thence North 11°07' West
765' to the point of curve bearing East and North to the East Right-
of-Way line of South 5th Street` and the North boundary line of Block 1,
Tennison Industrial; thence West along said boundary 40' to the West
Right-of -Way of South 5th Street; thence South and bearing West anal
South to the point of curve on the West boundary of Block 1, Tennison
Industrial; thence South 11°07' East 790' to the point of beginning;
and,
WHEREAS, said right of way or easement was donated to the City,
and the property was not dedicated by platting the property and causing the plat
to be filed of record; and,
WHEREAS, the dedication of such tract for a public street has not
been accepted and confirmed by an ordinance of the City Council specially
passed for that purpose, and the said street has not been connected to other

streets of the City, and it is proper that any such street be vacated and
aba~doned at the request of the donors of the right of way:
NOW, THEREFORE, be it ordained by the City Council of the
City of West Memphis:
Section 1: That the easement and right of way hereinabove fully
described be, and the same is hereby, released, relinquished and vacated
by the City of West Memphis and that any street, or purported street, located
thereon be vacated,
Section 2: The Mayor of the City of West Memphis i.s authorized
and directed to sign a proper release of this easement and right of way
quitclaiming any and all right and interest of the City of West Memphis, on
behalf of the City of West Memphis, and the City Clerk is authorized and
directed to attest the same.
