ORDINANCE NO._~
AN ORDINANCE FOR THE PURPOSE OF REZONING
CERTAIN REAL ESTATE IN KENDAL ADDITION TO
THE CITY OF WEST MEMPHIS, ARKANSAS: DECLAR-
ING AN EMERGENCY; AND FOR OTHER PURPOSES.
WHEREAS, a petition was filed with the City Planning Com-
mission and the City Council of the City of West Memphis, in Crit-
t¢nd¢n County, Arkansas, by Ed Graff and Mrs. Nola Richardson as
the owners of the hereinafter-described property praying that
said property b¢ rezoned as set out in tth¢ petition;
WHEREAS, the said City Planning Commission, after a hear-
ing in a regular meeting of said Commission held on March 13, 1958
iin accordance with the laws of fih¢ State of Arkansas and the or-
jdinances of the City of West Memphis, recommended to the City

Council of said City that said petition be granted;
~ WHEREAS, the City Council of the City of W¢st Memphis,
(in its regular meeting held on March 20, 1958, set the public hear
ing on said petition for April 17, 1958, at 3:00 o~ciock p. m.;
WHEREAS, a notice was duly published on the 20th day of
~, March, 1958, in a local newspaper of general circulation, as re-
quired by Ordinance No. 165 of said City, stating that, on the 17t
day of April, 1958, at 3:UO o~clock p. m., a public hearing would
b¢ held by the City Council of Th¢ City of West Memphis, Critt¢nde
it County, Arkansas, in the City Hall in said City for the purpose
~i of taking action upon said petition and calling upon all persons
CI having objections to such rezoning of said property as "D" Com-
~, mercial District to appear at said hearing to make known their
~ objections and notifying all other interested persons to appear
at said hearing so that they might b¢ heard; and

~~ WHEREAS, no person expressed a desire to b¢ heard, or
~j was heard, or made any protest, or appeared at said hearing to

~~ make any objection to such rezoning of said property and the Coun-
~~ cil finds that said petition should b¢ granted and said lands
should b¢ rezoned as requested;
NOW, THEREFORE, BE IT ORDAINED by the City Council of
The City of W¢st Memphis:
I.
Section I. That the following-described lands, located
in said City:
Lots 19 through 36, inclusive, Block 149,
Kendal Addition to the City of West Memphis ARKANSAS
now zoned' as A Residential District be, and the same are hereby,
REZONED as "D~~ Commercial District.
Section 2. All resolutions, ordinances and parts of or-
inces in conflict herewith are hereby repealed.
Section 3. A copy of this Ordinance, when duly certified
y the City Clerk, shall be entitled to be filed and recorded in

ithin and for Crittenden County, Arkansas.
Section 4. EMERGENCY CLAUSE. It is found and declared
y the City Council that, because of the need of coordinated,
djusted, and harmonious zoning of lands within the City of W¢st
iemphis, and particularly the lands her¢inbefore described, in
ccordance with a proper City plan, it is necessary for the pre-
ervation of the public peace, health, and safety that this Or-
inance become effective without delay. Therefore, an emergency
is declared and this Ordinance shall be in full force and effect
immediately upon and after its passage.
This Ordinance was passed and approved on this Ist day
f May, 1958.
