AN ORDINANCE ANNEXING A CERTAIN PORTION OF THE CITY OF WEST MEMPHIS,
ARKANSAS, TO STREET IMPROVEMENT DISTRICT NO. 4 OF WEST MEMPHIS,
ARKANSAS.
WHEREAS, parties claiming to be the owners of a majority in
assessed value of the real property located within the territory
hereinafter described, which property is contiguous to Street Improve-
ment District No. 4 of West Memphis, Arkansas, a duly created and ex-
fisting improvement district, have filed a petition praying that said
territory be annexed to said District for the purpose hereinafter set
out ; and
WHEREAS, after due notice as required by law, the City Coun-
cil of the City of West Memphis, Arkansas, has heard all parties de-
siring to be heard, and has ascertained that said petition was signed
by a majority in assessed value of the owners of real property within
said territory; now, therefore,
BE IT ORDAINED by the City Council of the City of West
Memphis, Arkansas:
SECTION 1. That the following described property in the
City of West Memphis, County of Crittenden, State of Arkansas, to-
wit:
Beginning at the intersection of the west line,
extended south of Rhodes Street with the north
line of the area marked Hulbert Yard of the Chi-
cago, Rock Island and Pacific Railway, run thence
in a generally easterly direction and southerly
direction along the north and east property lines
of said Hulbert Yard to its intersection with the
west line of the right of way of the Marion-
Hulbert cutoff of the St. Louis-San Francisco
Railway; thence in a straight line to the inter-
section of the center line, extended south of
the north and south alley in Block 35 of Kendal's
Subdivision in the City of West Memphis with the
north line of the right of way of the Chicago,
Rock Island and Pacific Railway; thence south
with the center line, extended south, of said
alley to its intersection with the center line of
the main bract of the Chicago, Rock Island and
Pacific Railway; thence in a westerly direction
along the center line of said main track to its
intersection with the west line, extended south
of Rhodes Street; thence mirth along the west line,
extended south of Rhodes Street to the point o]6
beginning,
be and the same is hereby added to and annexed to Street Improvement
District # 4 of West Memphis, Arkansas, and the commissioners of
said district shall proceed to make the improvements petitioned for
by paving Woods Street as an industrial street from the south line
of Broadway Avenue, south a distance of 4965 feet, in such manner and
with such materials as said commissioners shall deem to be for the
best interests of said territory hereby annexed and that the cost
thereof be assessed and charged upon the real property within the
territory hereinabove described.
SECTION 2. That said annexed territory shall be known as
"Annex No. 2 to Street Improvement District No. 4 of West Memphis,
Arkansas."
SECTION 3. That the Commissioners of Street Improvement
District No. 4 of West Memphis, Arkansas, shall make the assessment
of benefits for said improvements on the lots, blocks, or parcels of
real property in the territory herein annexed on the same basis as
if said territory were included in the original District, and shall
file said assessment with the City Clerk.
SECTION 4. That this ordinance shall take effect and be
in force from and after its passage.
