AN ORDINANCE REZONING W~, BLOCK 36, KENDAL ADDITION TO THE CITY OF
WEST MEMPHIS, ARKANSAS, AS A "D" CONTN~RCIAL DISTRICT.
iihereas, on the 12th day of February, 1959, the Planning Commission
met for the purpose of determining in what classification the lands hereinafter
described should be rezoned, and after hearing the owner of said lands, all
other interested persons, and from all inf ormation, and. all other tYLi.ngs
before the Planning Commission, it was the finding of the Planning Commission
that said lands should be rezoned as "D" Commercial District, and
Whereas, Notice was duly published on the 23rd. day of I''ebruary, 1959,
that a hearing would be held. before the City Council at 7:30 P.M. on Thursday,
March 19, 1959, for the purpose of hearing all interested parties in connection
with the rezoning of the lands hereinafter described, and
Whereas, at said, meeting the owner of said land appeared and requested
that the same be rezoned as a "D" Commercial District, and
Whereas, no persons appeared to protest against rezoning said lands as

a "D" Commercial District and a~°ter hearing the owner and other interested
persons. the Council finds that said lands should be rezoned as a "D"
Commercial District, now
BE IT ORDAINED BY THE CITY COUNCIZ OF' THE CITY OF WEST T~NTPHIS:
SECTION 1. "D" CO'~.CIAL DISTRICT: That the following lands, to-wit:
W~ OF BLOCK 36, KENDAI~ ADDITION TO THE
CITY OF WEST MBI~4PffIS, ARKANSAS
be and the same is hereby zoned as "D'r Commercial District.
SECTION 2. ORDINANCES IN COTJFLICT HERE~iJITH REPEALED: All Ordinances
or parts of ordinances in conflict herewith are hereby repealed..
SECTION 3. EMERGENCY CLAUSE: It is found and declared by the City
Council that the above lands are in the process of having improvements erected
thereon, and it being necessary that said lands be rezoned before said improve-
ments are erected thereon, and tltii.s ordinance being necessary for the immediate
preservation of the public peace, health and safety of the citizens of the City
of West I~Temphis, an emergency is hereby declared to exist and this ordinance will
take effect and be in full fjor~%ce immediately upon its passage and approval.
