377-- . ORDINANCE NO. J ~ / ,;, r .. ~~ r AN ORDINANCE TO REZONE CERTAIN ZONED PROPERTY AND TO REPEAL ORDINANCES IN CONFLICT HEREWITH. WHEREAS, a petition has been filed with the City Planning Commission of the City of West Memphis by William L. Johnson Co., Inc., as the owner of the hereinafter described property and was heard by that Commission in a regular meeting on the ~a v day of fem b~ r fl9~-~-Y 1959, as provided by statute and the ordinances of the City of West Memphis; and WHEREAS, notice was duly ~~ublished on the (~ Lday of ~e-p'E~n be Y 1959, that a hearing would be held by the City Counnn~~cil of the City of West Memphis at ~ o'clock {~ M. on I"©il~fY~ ~~'~ 5 , 1959, for the purpose of taking action upon such petition and calling upon all interested parties to appear at such hearing to make known their objections, if any, in connec- tion with the petition for rezoning of lands hereinafter described; and WHEREAS, at said meeting and by the petition previously filed with the Council, it was requested that the following lands, to-wit: All of Southcrest Subdivision except Lots M through W, inclusive, in Block B and Lots A through L, inclusive, in Block C, be zoned as "F" Light Industrial District; and WHEREAS, no persons appeared to offer a protest against the rezoning of said lands as requested, the Council finds that the petition should be granted and said lands should be rezoned as requested, now therefore, BE IT ORDAINED BY THS CITY COUNCIL OF THE CITY OF WEST MEMPHIS, ARKANSAS: SECTION I. "F". LIGHT INDUSTRIAL DISTRICT: That the following lands, to-wit: All of Southcrest Subdivision except Lots M through W, inclusive, in Block B and Lots A through L, inclusive, in Block C, be, and the same are hereby rezoned as "F", Light Industrial District. •. - 2 - .. ., SECTION II. ORDINANCES IN CONFLICT HEREWITH REPEALED: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION III. EMERGENCY CLAUSE: It is found by the Council that the present zoning of the above described lands is not appro- priate for the proper and orderly development of the City of West Memphis and, in order to maintain an orderly system of zoning of districts within the City of West Memphis in keeping with a proper city plan for the orderly development of the city, it is necessary that rezoning of the above-described property be immediately accom- plished and, therefore, an emergency is found to exist and this ordinance shall be in full force and effect from and after its pass- age, approval and publication as required by law. SECTION IV. COPY OF ORDINANCE FILED FOR RECORD: A copy L of this ordinance, when duly certified by the City Clerk, shall be subject to being filed and recorded in the office of the Circuit Court Clerk and Ex-Officio Recorder within and for Crittenden County, Arkansas.
