AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE OF
PARATACTICAL BODY ARMOR NEEDED FOR THE WEST MEMPHIS POLICE
DEPARTMENT, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows
waiving of competitive bidding in exceptional situations where
such procedure is deemed not feasible or practical; and
WHEREAS, the West Memphis Police Department Special Response
Team currently has substandard tactical ballistic raid vests,
which is a risk to the officers; and
WHEREAS, the Paraclete Modular Ballistic Raid Vests is a
patented item and specifications required by the West Memphis
Police Department S.R.T. are not met by other manufacturers; and
WHEREAS, Lightfighter Tactical from Ft. Campbell, Kentucky,
has quoted a price for the purchase of sixteen vests with
accessories in the amount of $34,02080; and,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following
item to be used by the City, described as follows:
Purchase of eighteen Paraclete Modular Black Carriers with
accessories in the total sum of $34,020.80 from Lightfighter
Tactical from Ft. Campbell, Kentucky.
2. EMERGENCY CLAUSE. It having been found and determined
by the City Council of the City of West Memphis, Arkansas, that
there is an urgent and immediate need by the S.R.T. of the West
Memphis Police Department for the maximum level of safety for the
officers, an emergency is hereby declared to exist, and this
ordinance being necessary for the preservation of the public
health, safety, and welfare of the citizens of West Memphis,
Arkansas, shall be in full force and effect from and after the
date of its passage and approval.
