204ORDINANCE N0. 1~~-~--- BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS, ARKANSAS: WHEREAS, a petition was duly filed with the City Council of the City of West Memphis, Arkansas, on the 7th day of December,1951, asking the City Council to vacate and abandon the alley upon, over and aoross Block "C" of the Lyndon Addition to the City of West Memphis as shown by plat of record in Plat Book 1 at page 70 in the office of the Circuit Clerk and Ex-Officio Recorder within and for Crittenden County, Arkansas, said alley being unnamed and unnumbered and across said Block "C" of the Lyndon Addition to the City of West Memphis. ~. WHEREAS, after due notice as required by law, the City Council has, at the time and place mentioned in the Notice, heard all persons desiring to be heard upon the question, and has ascer- tained that said alley ray has heretofore been dedicated to the public use as an alley; that the same has not actually been used by the public generally for the past five years, or in fact, at any time subsequent to its dedication; that all the owners of property abutfi upon the portions of said alley be vacated have filed with the Council their written consent to such abandonment and that the public welfare will not be adversely effected by the abandonment of said alley or passageway. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS, ARKANSAS: SECTION 1. The City of West Memphis, Arkansas hereby re- leases, vacates and abandons all its right, together with the rights of the public generally, in and to the portion of the alley or pass- age described as follows: That certain alley upon, over and across Block "C" of said Lyndon Addition, separating Lot Five (5) on the North and Lots One (1), Two (2), Three (3) and Four (4) on the South in said block as shown by plat of record in Plat Book 1, page 70 in the office of the Circuit Clerk and Ex-Officio Recorder in and for Crittenden County, Arkansas. SECTION 2. A copy of this Ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Deeds in and for Crittenden County, Arkansas. SECTION 3. This Ordinance shall take effect and be in force from and after its passage and approvel. Bland Mitchell, Bishop of Arkansas~Protestant Episcopal ~/ Churah, is now the owner and holder of the legal title to the following described property, to-wits Lots One (1), Two (~), Three (3), Four (It) and Five (5), Block "C" of the Lyndon Addition to the City of West Memphis, Arkansas, as shown by plat found of record in Plat Book 1 at page 70 in the office of the Circuit Clerk and Ex Officio Necorder within anal for Crittenden County, Arkansas. 1Nhereas, all of said block is now owned and/or the legal title held by the said R. Bland Mitchel-l-, and 1Nhereas, it is the desire of the owner of said lots that the alley upon, over and across said block be abandoned and closed for the reason that the present owner contemplates building upon said blocky and that said buildings will be so constructed that said building or parts thereof gill be situated upon and aver said easement, and YPhereas, the present owner has no use for said alley and desires that the same be closed, and since the present owner owns all of the lands abutr ing on each side of said alley, or passageway, is entitled to petition the City Council of said City of West Memphis to abandon said alley and/or passageway, noon I, R. Bland Mitchell, being the owner and/or holder of the legal title to all of the above described block hereby request and petition that said alley and/or' Passageway be abandoned, and I further state that I will loin i.n an agreement with the City of West Memphis as prescribed by Section 19-3817 (Arlt.
