2533 ORDINANCE NO. 2633
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR REPAIRS OF THE
WEST MEMPHIS FLOOD PUMP STATION, DECLARING AN EMERGENCY
AND FOR OTHER PURPOSES.
WHEREAS,Arkansas Code Annotated Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure is deemed not feasible or
practical; and
WHEREAS,there are many items necessary for the City's use where competitive
bidding is deemed not feasible or practical: and
WHEREAS,the City of West Memphis and the West Memphis Utilities are in need of
having repairs made to the West Memphis Flood Pump Station due to damage caused from the
water table being raised by the continuous high river level around the flood pump station. As a

result, couplings connecting the pump discharge lines have prematurely reached their end of life
and have begun to fail and leaking water when operating: and
WHEREAS,the rainy season has begun,will last several months and the pumps will
need to be operated frequently during this season; and
WHEREAS, Chris Hill Contractors is currently working in the City for the West
Memphis Utility Commission repairing sewer lines experiencing similar issues and has the
equipment, manpower and skills to immediately begin work to repair the discharge lines, and
competitive bidding under such circumstances would not be feasible or practical:
NOW,THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS:
1. That competitive bidding be waived for the following item to be used by the City.

Repairs to the West Memphis Flood Pump Station at an estimated cost of$61.725.00.
2. EMERGENCY CLAUSE. It having been found and determined by the City Council
of the City of West Memphis, Arkansas, that the repair of the West Memphis Flood Pump
Station is necessary in order to keep the pump station operational and to help prevent flooding in
the City of West Memphis and that there is an urgent and immediate need for said repairs to be
completed, an emergency is hereby declared to exist, and this Ordinance being necessary for the
preservation of the public peace, health, safety and welfare of the Citizens of West Memphis,
Arkansas, shall be in full force and effect from and after the date of its passage and approval.
