2543 ORDINANCE NO. 25g3
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR REPAIRS OF
APPROXIMATELY 115 FEET OF ROADWAY PAVEMENT ALONG FAMILY DOLLAR
PARKWAY, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure is deemed not
feasible or practical; and
WHEREAS, there are many items necessary for the City's use where competitive
bidding is deemed not feasible or practical, and
WHEREAS, the City of West Memphis Public Works Department is need of
having repairs made to 115' of roadway pavement along Family Dollar Parkway, and
competitive bidding under such circumstances would not be feasible or practical;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS
1. That competitive bidding be waived for the following work to be done by Crisp
Contracting, described as follows
Remove and replace 115 lineal feet of roadway paving and substructure in
accordance with agreement between the City and Crisp Contracting in the total amount
of$105,955.10.
2. EMERGENCY CLAUSE. It having been found and determined by the City
Council of the City of West Memphis, Arkansas, that the immediate repair of the
roadway section is vital to prevent unnecessary delays in the construction schedule of
the Carvana facility which will create a substantial number of much needed jobs within
the City of West Memphis, an emergency is hereby declared to exist, and this
Ordinance being necessary for the preservation of the public peace, health, safety and
welfare of the Citizens of West Memphis, Arkansas, shall be in full force and effect from
and after the date of its passage and approval
