AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE
OF THE PROPERTY AT 3505 EAST POLK
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure is deemed not feasible or
practical; and
WHEREAS, the Federal Emergency Management Agency (FEMA) has made grant
funds available for the acquisition of property in floodplains that have suffered repetitive flood
lasses; and
WHEREAS, the house at 3505 E. Palk was included in the grant application and meets
all FEMA requirements to be eligible for its program; and
WHEREAS, the house at 3505 E. Polk has been appraised for $23,000; and
WHEREAS, the owners of 3505 E. Polk, Reverend Henry & Carolyn Showers have
been made aware of the FEMA program and have accepted the appraised valuation of the
property; and
WHEREAS, the City of West Memphis wishes to purchase the property for $23,000 and
to demolish the house to remove it as a future potential repetitive flood loss in accordance with
the FEMA program; and
WHEREAS, The City of West Memphis wishes to pay Reverend Henry & Carolyn
Showers the appraised value of the house, $2,000 moving expense, and the City will pay all
closing costs.
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the purchase of the property at 3505
E. Polk and the owners of the property, Reverend Henry & Carolyn Showers
be paid the appraised valuation of $23,000 for the property, $2,000 for moving
expenses, and the City of West Memphis will pay all closing costs.
2. That the agreement between the City of West Memphis and Reverend Henry &
Carolyn Showers is hereby approved and the Mayor and the City Clerk are hereby
authorized to execute the necessary purchase contract.
