236;- oR~INANCE No. z~ ~ ,* t~HEREAS, on August ].la., 1952 the Planning Com~ai.ssion of the City of West Memphis recommended to the Ci~,y Council of the City of West Memphis ,. that the lands lying Mast of lltth Street and West of the drainage canal, which lies East of 21st Street and running North and South, South of Jackson Avezrue and North of the Chicago, Rock Island and Pacific Railroad be re-zoned to a "B"-two-family residence district, and WHEREAS, on the 2nd day of September, 1952, Notice was published in the Crittenden County Times giving notice of an intention to re-zone that portion of the City of Nfest Memphis lying East of lath Street to the City Limits, South of Jackson Avenue and North of the Chicag©, Acck Island and Pacific Railroad now classified as "D" -Commercial District and "F" -Light Industrial District to "B" - Two•-Family Residence District, and ~REIIS, no persons appeared on said date to protest and the matter was continued to 7s30 P. M., October 21, 1952, and %iEREAS, it appears to the Council that it could b® more advisable to re-zone those lands lying East of 7.ltth Street, West of 21st Street, South of Jackson Avenue and North of the Chicago, Rock Island and Pacific Railroad to a "B"-two-family residence district instead of extending said district to the drainage canal as recommended by the Planning Con~- misaion or to the eastern city limits as provided in the notice of said hearing, .;and 1NHLFiEAS, no persons have appeared on this date, October 21, 1952, to object to the re-zoning of said lands, nor ~; IT OR1]AIA~D BY THE CITY COUNCIL OF THE CITY OF WEST ~EMPHISs SECTION 1 -DISTRICT AND BOUNDARIESa The boundaries of the districts as shown on the zoning district map shall be amended as follows That portion of the lands shown on the "Zoning District Maps lying East of 11ath Street, West of 21st Street, South of Jackson Avenue and ,. ~ • North of the Chicago, Rack Island & Pacific Railroad be and the same are hereby re-classified and re-zoned as a "B" - TRO Family Residence District, and that portion of Section 2 of Ordinance No. lb5 passed and approved on the 21st day of April, 19?~9 is amended. to conform here~rith but not otherwise. SECTION 2 - TP~R(~NCY CRUSE: It appearing that this ordinance is necessary for the immediate preservation of the public peace, health and safety of the citizens of West Memphis, an emergency is declared to exist and this ordinance shall be in full force and effect from and after .its passage and approval.
