WHEREAS, Ordinances No« 57 passed and approved on Nay 11, 1937,
No. 69 passed and approved on April 12, 1938 and No. 72 passed and
approved on May 7, 1938, xhich said ordinances provide for setback along
Highxays 61-and 70 and said ordinances were in conflict xith Ordi nanee`8
No. lb5 passed and approved on April 21, 19l~9, and
WHEREAS, confusion exl.sts as to what is the proper setback
along said highxays, and
WHEREAS, the setback is irregular and xould be difficult to
accurately describe, and
WHEREAS, the City Engineer has prepared a map shoxing the setback
along said highxays From the northern City Limits xhere said HigYavay 61
enters the City Limits to its intersection xith Highway 70, and the set-
back along Highway 70 from the Western to the Eastern City Limits and
which plat correctly and accurately shoxs the setback along said high-
*ays in the various blocks, nox therefore
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST NEMPHISt
SECTION 1 ..Adoption of Setback Alor~ Highxays 61 and 70 and
Adopting Plats That the plat prepared by W. H. Cushman, Civil Engineer,
on November 5, 1952, showing the setback along Highway 61 from the
northern city limits to its intersection with Highway 70 and the setback
along Highway 70 through the City of West Memphis be and the same is
hereby adopted as the setback along said highways and the plat attached
hereto and incorporated herein by reference thereto is also hereby adopted
as the official plat providing the setback along said Highxays 61 and 70.
Be it further ordained that a copy of this Ordinance together
xith the original of the plat attached hereto be recorded in the Office
of the Circuit Clerk and Eg-Officio Recorder xithin and for Crittenden
County, Arkansas, and xhen the same shall have been properly signed and
acknovrledged by the Mayor and City Clerk of the City of West Memphis,

the same shall be subject to being placed of record in the office of
said Cleric and Ex-Officio Recorder within and for said Crittenden County,
Arkansas„
SECTION 2 ~ Conflicts Ordinances or parts of ordinances in
conflict herewith are hereby amended as herein provided but not otherwise.
SECTION 3 - Emergency Clauee.t It being determined that a proper
setback along Highways 61 and 70 is needed; that the present orci3.nances
providing for said setback are in conflict and this ordinance being
necessary to establish a proper setback along said highways, shall be
in full force and effect from and after its passage and approval.

said Municipal Corporation, and further stated and acknowledged that they
had so signed, executed and delivered said foregoing instrument for the
uses and purposes therein mentioned and set forth.
