ORDINANCE N0.
AN ORDINANCE INCORPORATING CERTAIN TERRITORY ADJACENT TO THE CITY
OF WEST MEMPHIS IN THE CORPORATE LIMITS OF THE CI'T'Y 0~' WEST M~'IPHIS,
WHEREAS, on the 4th day of November, 1952, there was submitted to
the voters of the City of West Memphis, the question of whether or not
Avondale Gardens Subdivision should be annexed to the City of West Memphis,
and
WHEREAS, at said election 142$ votes were cast in favor of said
annexation and 95 votes were cast against said annexation, and
WHEREAS, it appeared that a majority of the voters of West Memphis
approved said annexation, and
WHEREAS, there was filed a petition in the County Court of Crittenden
County, Arkansas, under proper resolution of the City Council, said petition
being signed by the mayor and city clerk of the City of West Memphis, petition-
ing the County Court stating that it would be to the best interest of the City
of West Memphis and the citizens thereof, that said territory be incorporated
into the City of West Memphis, and
WHEREAS, on the 23rd day of December, 1952, the County Court of
Crittenden County, Arkansas, made an order annexing said land thereon
described to the City of West Memphis pursuant to said petition, and
WHEREAS, more than 30 days have elapsed since said order was made
by the County Court of Crittenden County, Arkansas, and no objections having
been filed to said order of annexation, now
THEREFORE, BE IT ORDAINED BY `fHIiJ CITY COUNCIL OF THE CITY OF WEST
MEMPHIS
SECTION 1. That the following described lands contiguous to and

adjoining the City of West Memphis, Crittenden County, Arkansas, to-wit:

The South Half (S) of Section One (1) Township
Six (6) North, Range Eight ($) East consisting of
320 acres of land, and known as Avondale Gardens
Subdivision
A plat of said lands, prepared by C. H. Bond, Jr., Civil Engineer,
under date of November 1, 1952, is attached hereto and is made a part of this

ordinance, and that the said lands described are hereby annexed and accepted
and incorporated into the City of West Memphis, to be known as Avondale
Gardens Subdivision to the City of West Memphis.
~`" SECTION 2. Emergency Clause - It appearing to the City Council that
the above described lands are contiguous and adjacent to the City of West
Memphis; that said lands are being subdivided and sold for residential and
other purposes; that it is necessary that this Ordinance be passed and said
lands be incorporated into the City of West Memphis so the proper zoning
ordinances may be passed and construction regulated and supervised, an
emergency is declared to exist and this Ordinance shall be in full force
and effect from and after its passage and approval.
