Z~ WHEREAS, a petition was duly filed with the City Council of the City of West Memphis on October 4, 1954, asking the City Council to vacate and abandoxa a portion of Niriete~enth Street, which portion of said street extends from Goodwin AveMUe on the South to Wheeler Avenue on the North and lies immediately i~Test of Block Nineteen (19) and immediately East of Block Twenty (20) of the Wheeler Subdivision to the City of West Memphis as now appears on record as per plat of said subdivision prepared lay C. H. Bond, Civil Engineer, and. of record in Plat Book One (1) at pages 264 and. 265 of the Records in the Office of the Circuit Court Clerk and Ex+~Officio Recorder in and for Crittenden County, Arkansas. WAS, after due notices as required by law, the Council L has, at the time and place mentioned in the notices, heard. all pers~ans desiring to be heard on the question and has ascertained that the portion of the street, as hereinbefore described, has heretofore beex dedicated to the public use as a street herein described.; that said street is unimproved and has got beam actual ly used by the public generally for a period of at least five (5) years preceding this date; that all of the owners of the property abutting upon the portion of the street t`o be vacated have filed with the Council their written consent to such abandon merit; and that public interest ar~d welfare will not be adversely affected by the abandonment of such portion of Nineteenth Street. STOW, THEREE'ORE, BE IT ORDAINED BY TAE CITY CE~UNCIE, OF THE CITY OF i~TEST MEliPHIS, ARKANSAS SECTION 1. The City of West Memphis hereby releases, vas sates, and abandons all its rights, together with the right of the public in general, in and to that certain portion of Niner teenth Street designated as follows: That portion of Nineteenth Street which ex» tends from Goodwin Avenue on the South to Wheeler Avenue on the North and lies immedi« ately West of Block Nineteen (19} and im~• mediately East. of Block Twenty (2d) of the Wheeler Subdivision to the City of West ~~~ _ ~ •.. This ordinance being for the immediate protection of the public peace, health and safety, and in the i~tterest of the public, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage.
