WHEREAS, a petition was duly filed with the City Council of
the City of West Memphis on July 19, 1955, asking the City Council to
~ vacate and abandon the following streets and alleys:
That portion of Nineteenth Street which portion extends from the
North Line of ~Jheeler Avenue to the City Limits of the City of West Memphis,
and lies immediately West of Blocks 6 and 9 of the Wheeler Subdivision to
the City of West Memphis, and immediately East of Blocks 7 and 8 of the
Wheeler Subdivision to the City of West Memphis, as shown by plat of said
Subdivision prepared by C. H. Bond, Civil Engineer, and recorded in Plat
Book 1 at Pages 264 and 265 of the Records in the Office of the Circuit Court

to the City of West Memphis, as shown by plat of said Subdivision prepared by
C. H. Bond, Civil Engineer, and. recorded in Plat Book 1 at Pages 264 and 265
of the Records in the Of~"ice of the Circuit Court Clerk and. Ex-officio Re-
corder in and for Crittenden County, Arkansas; and
That Alley extending from the West side of Parkway Street through
Blocks 15, 16 and 17, to the East side of Ingram Boulevard, of the Wheeler
Subdivision to the City of west Memphis, as shown by plat of said Subdivision
prepared by C. H. E3ond, Civil Engineer, and recorded in Plat Book 1 at Pages
261 and 265 of the Records in the Office of the Circuit Court Clerk and Ex-
officio Recorder in and for Crittenden County, Arkansas.
WHEREAS, of ter due notices as required by law, the Council
has, at the time and place mentioned in the notices, heard all persons
desiring to be heard on the c{uestion~and has ascertained that the streets
and alleys as hereinbefore described, have heretofore been dedicated to the
public use as streets and alleys herein described; that said streets and
alleys are unimproved and have not been actually used by the public generally
for a period of at least five (5) ,years preceding this date; that all of the
owners of the property abutting upon the portion of the streets and alleys
to be vacated have filed with the Council their written consent to such aban-
donment; and that public interest and welfare will not be adversely affected
by the abandonment of such streets and alleys.
NOW, THEREFORE, BE IT ORDAINED HY THE CI Tx COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
SECTION I. The City of West Memphis hereby releases, vacates,
...r and abandons all its rights, together with the right of the public in

general, in and to the following streets and alleys:
That Portion of Nineteenth Street which portion extends from the
North Line of Wheeler Avenue to the City Limits of the City of West Memphis,
and lies immediately West of Blocks 6 and 9 of the Wheeler Subdivision to

Wheeler Subdivision to the City of West Memphis, as shown by plat of said

264 and 265 of the records in the Office of the Circuit Court Clerk and Ex-
officio Recorder in and for Crittenden County, Arkansas.
SECTION II. A copy of the ordinance duly certified by the City
C1¢rk shall be filed in the Office of the Recorder of Crittenden County, Arkansas.
SECTION III. This ordinance being for the immediate protection of
the public peace, health and safety, and in the interest of the public, an emer-
gency is hereby declared to exist and this ordinance shall be in full force and
effect from and after its passage.
