AN ORDINANCE VACATING AND ABANDONING THE UDTNAMED STREET NITHIN THT
BOUNDARIES OF N. A. GAGE SUBDIVISION TO THE CITY OF NEST E~dPHIS,
ARKANSAS
NHF$$AS, a Petition was duly filed with the City Counoil of the
City of West Memphis, Arkansas, on the 7th day of January, 194?; asking

the Office of the Cirouit Court Clerk and Ex-Officio Reoorder of
Crittenden County, Arkansas, Which said unnamed street appears as part
of Fib Street on the Plat of the said M. P. Horsley Addition to the
City of West Ee~nphis, Arkansas, recorded on Pages 4 and 5 of plat Book 1,
in the offiQe of said Recorder, and

for tiro successive Weeks in the Crittenden County Times, a neWSpaper hav-
ing a general circulation i.n West Memphis, Arkansas, that a hearing Would
''" be had upon said Application to vacate said portion of said street on

of West Memphis,• Arl~nsas, and
NSERFAS, the City Council has at the time and place mentioned in
said Notice heard all persons desiring to be heard upon said applicatiaa
and has ascertained that the portion of the street hereinbefore described
has heretofore been dedicated to the public use as a street herein described;
that said portion of said street is not noW and has not been actually used
by the public generally for a period of at least five years subsequent to
its dedication; that all of the owners of the property abutting upon that
portion of the street sought to be vacated have filed With the Council

SECZ~ION 1. The City of hest Memphis, Arloa.nsas, does hereby release,
vaaate and abandon all of its right, title and interest, together with
the rights of the.publia generally in and to the following described
portion of a street situated in the City of y~est Memphis, Crittenden
County, Arkansas:
That part of Fifth Street in the City of Pest Memphis,
Arkansas, embraoed within the boundaries of W. A• Gage
Subdivision as shown. by Plat of reoord in Plat Book 1,
Page 60 in the Offioe of the Cirouit Court Clerk and
Ex-Offioio Rsoorder of Crittenden County, Arkansas, on
which Plat said Fifth Street appears as an unnamed
Strset, vk~ioh is bounded on the west by Blook (one of
said ~. A. Gage Subdivision and on the East by a 11 of
Block Tiro of said Subdivision except the North 104.37
feet thereof. Said uru~aaed street is also shoavn as a
part of Fifth Street on the Plat of the M. p. Horsley
Addition to the City of 1~est Memphis, Arkansas, recorded
in Plat Book 1 at Pages 4 and b in the Offioe of the
Cirouit Court Clerk and Ex-Officio Reoorder of Crittenden
County.
SECTION 2. A Dopy of this Ordinance duly oertified by the City Clerk
shall be filed in the offioe of the Cirouit Court Clerk and Ex-Offioio
8®aorder of Crittenden County, grkansas, and reoord®d in the deed records
of said County.
SECTION 3. Thi+a Ordiaax-ae being necessary for the pa~eservation of
.'~ the public pesos and happiness, an emergency is hereby found and declared
to exist and this Ordinanoe shall be in full force and effect from and
after its passage and approval.
