BE IT dRDAINED BY THE CITY COUNCII, OF THE CITY OF WEST MEMPHIS:
SECTION 1:
From and after the passage and approval of this
Ordinance it shall be unlawful for any person, persons,
partnership or corporation to drive or operate upon any improved
or hard-surfaced street of the City of West Memphis any tractor,
truck,~trailer, automobile or other vehicle having corrugated,
spiked, pointed or other rough surfaced metal tires, without firs
obtaining from the Mayor of the City of West Memphis a permit to
so use or operate such tractor, truck, automobile or other
vehicle,
SECTION 2:
Any person, persons, firm, partnership or corporation
operating such tractor, truck or other vehicle upon any paved or
hard-surfaced street and damaging the same shall, in addition
to any other punishment provided for, be liable to the City of
West Memphis for damages to said street, Should any person,
persons, firm, partnership or corporation drive such tractor,
truck or other vehicle upon any paved or hard-surfaced street of
the City of West Memphis and damage the same, such damage to
said street shall forthwith be determined by tae City Engineer
and such person, perso~~s, firm or corporat on owning or
operating said tractor, truck or other ..vehicle shall, in addit
to any other fine, penalty or forfeiture, pay said sum into the
Street Improvement Fund of~ the ,City of West Mem~l~.s. „_~ ~,., _ ~~
''3LCTION 3:
Any person, persons, firm, partnership or corporation
found guilty of violating any provisions of this ordinance shall
be deemed. guilty of a misdemeanor and upon conviction thereof
smell be fined in any sum not exceeding the sum of $100,00.

It appearing that tractors, trucks 'and-other vehicles
with corrugated, spiked, jointed or other rough surfaced metal
tires have been driven upon the streets of West Memphis; that the
same have-.been damaged. and.. that no adequate remedy has been
provided to punish such persons, it is hereby declared~tYi~t an
emergency exists an8 this ordinace is necessary for the immediate
preservation of the hard-surfaced streets and public ways of the
City of West Memphis, and that this ordinace shall be'in effect
from and after the passage of its approval,
