SYST t.dt TC1 SERVE I~fOR'I'Hli~(~TON PkI~K ADDITIi~Iv `1'0 'J~'HE CI'.i'Y OF WEST l:~t=?,MPHTS, A~~ANSAS . ,~ , VV~iFREAS, the City of ~+est R~emphis, Arkansas, owns and apex~ates a municipal sewer system an which it has outstanding the balance of a series of ao~~bined improvement and refunding bonds dated June 1, 1845, authorized by Ordinance Noy 107 oi' the City of West Memphis, Arkansas, passed and approved on the 6th day of July, 1945, but under the terms of 5estian 6 of said ordinance, 46,0DD of said bc~n~s , b©arin~ intorest at the rate of 3~ per annum, have been prepared but xzave been retained by the City Q 1.. ®.r•,~~:k in an unexecuted form for subsequent issuance and sale, sub~est to the limitations and restrictions placed • upon their iseuanae and sale by th® provisions of Section 9 oP said ardinancter; and WHEREAS, section 7 of said ordinance provided that v~rhenever art June 15 ar December 15 of any year the amount in th~- Be~rerr revenue Bond Fund is sufficient to pay all interest and principal to become due on outstanding bonds during the ensuing twE~lve months and the unapportioned revenues far the operation of the sewer system are in excess of the estimated amount r®quired to pay tYis cast o f operation and maintenance of said system for the ensuing period of six months, then such excess of sash unapportioned revenues may be transferred t a said Sewer Revenue Bond Fund ar may t,e othe~aisd disposed of~ as the City Caunail of said City may from time to ti~~e ord®r and direst; and proseedin{; under this authority the City, in arc~er to pay ~. the contractor tie balance dud him on the sonstrustion of the sewer system, issued a seriaa~ +~f v~28,(304 of surer revenu® certificates dated January 1, 1947, and pledged this surplus •as above defined to the payment of these certificates, +~~ hiah will mature serially on January 1 of the yea re 1948 to 1952, inclusive, thus pledging for definite purposes all of the revenues to be derived from the operation of the sewer s~rstem; and WHER~.~AS, the Guaranty Loan ~ Real Estate Company, a oorporation, has developed an addition to the City of West Memphis, known as ~orthing~on park Addition, tiVest Memphis, Arkansas, as shown by the plat of said addition reoorded in Plat Book 1 at pages 188 and 189, of the records in the offioe of the Circuit Clerk and ex officio Reoordar of Crittenden County, Arkansas, and because it was necessary to provide the houses in s aid addition with sewer service, the oorporation has laid th® necessary sewer laterals and extensions to serve said addition, at a cost of ~p12,040, which the corporation has paid, but the laterals and extensions which it has built in said Worthington Park Addition have now been integrated with and Made a part of the West Memphis municipal a~ewer system and the improved properties in said Worthington Park Addition are paying the sewer charges according to the schedule of rates adapted by the City of Went Memphis and set out in Ordinance No. 108, passed July 24, 1945, and the oorporation is entitled to the refund of the m©ney which it has advanced in making these sewer sxtensians, but the City has no funds to repay this advance but when it issues the additional bonds of the June 1, 1945, issue, which have bean authorized but not issued, it can pay and discharge this obligation; Ai0'N, TH~:REF~R3~., F3F IT ~JRDAINEI~ by the City Couxaoil of the City of Went Memphis, Arkanssst SECTION 1. That tre City Council hereby aocspts ae a part of the Went Memphis municipal sewer system the sewer mains and laterals laid in Warthington Park Addition to the Citq of West Memphis, Arkansa s, by the Guaranty Laan ~ Real Estate Company, a oorporation, and the users of said extensions and laterals shall pay to the City of West Memphis the usual and customary charges for seller servioe as fixed by Ordinance No. 1©8y passed and apprc-ved on the 24th day of July, 1945• ~, y SECTION 2.
