ORDINANCE N0. 1~5
AN ORDINANCE TO PROVIDE FOR THE USE AND OPERATION OF
MOTOR VEHICLES, REGISTRATION AND LICENSING THEREOF,
LEVY OF LICENSE FEE THEREFOR AND TO PROVIDE FOR A
PENALTY FOR VIOLATION THEREOF.
BE IT ORDAINED by the City Council of the City of
West Memphis, Arkansas.
SECTION 1. LEVY OF LICENSE FEE - There is hereby
levied and assessed the sum of Five 0 5.00) Dollars
on each motor vehicle, as defined by the Statutes of
the State of Arkansas, used and/or operated upon the
streets, alleys and public ways oP the City oP West
Memphis, Arkansas.

tag therefor. Said tag shall at all times be displayed
upon the rear oP the motor vehicle for which it was issued.
SECTION 3. TA.A.NSFER OF LICENSE TAG - Such license
tag shall not be used or displayed -:upon any other vehicle
other than that for which it was issued unless application
be made to the City Clerk for a permit to transfer said
license tag and, iP approved by the Clerk, a permit to
transfer said license tag may be issued Por which there
is hereby levied a Pee of One 01.00) Dollar, which shall
be collected at the time oP the issuance oP the permit.

SECTION ~.
EXCLUSIONS - This Ordinance 8ha11 not
be construed to apply to any vehicle owned by the State
of Arkansas, or any political subdivision thereof, or
to vehicles held or owned by a regularly licensed dealer,
who shall own and hold the same for the purpose of resale.
SECTION 5. LICENSE FEES PAID PROPORTIONATELY - WHEN
AND HOW - All fees Por the registration of motor vehicles
shall be for each calendar year beginning January 1, 1948,
provided that registration for license upon which they are
based is issued prior to June 30th. If such registrations
and licenses are issued after June 30th and prior to
September 30th, the charge shall be one half (~)~of that
for the calendar year. If such registrations and licenses
are issued after September 30th, the charge shall be one-
fourth (~) of that for a calendar year.
All registrations and licenses issued under the pro-
visions of this Ordinance shall expire at midnight on
December 31st of the year for which registrations and
licenses may be issued.
SECTION 6. PENALTY - Any person who shall keep and/or
use any motor vehicle upon the attests, alleys and ways
of the City of West Memphis without first having secured
a license as provided herein and paid the Pee therefor
shall be deemed guilty of a misdemeanor, and upon convic-
tion thereof shall be fined in any sum not exceeding
X50.00.
SECTION 7. REPEALING CLAUSE - Ordinance No. 24 passed
and approved September 5, 1933, is hereby repealed.
.' SECTION 8. SEVERALTY CLAUSE - Should any word, phrase,
sentence or paragraph of this Ordinance be held or constru-
ed by any Court to be illegal or unconstitutional for any
reason, such holding shall not aff eet the other provisions
of this Ordinance.

SECTION 9• EMERGENCY CLAUSE - It being necessary
to raise money for the repair and maintenance 6f the
street, alleys and public ways of the City of West
Memphis, an emergency is hereby declared to exist,
and this Ordinance being necessary for the immediate
preservation of the public peace, health and safety,
it shall take effect and be in full force and effect
upon~and after January. 1, 1948.
