AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE
PURCHASE OF THE PROPERTY AT 415 AUBURN STREET
WHEREAS, Arkansas Code Annotated Section I4-58-303 aIIows waiving of
competitive bidding in exceptional situations where such procedure is deemed not feasible or
practical; and
WHEREAS, the Federal Emergency Management Agency (PENH) has made grant.
funds available for the acquisition of property in floodplains that have suffered repetitive
flood losses; and
WHEREAS, the house at 415 Auburn Street was included in the grant application and
meets all FEMA requirements to be eligible for its program; and
WHEREAS, the house at 415 Auburn Street has been appraised at $86,500; and
WHEREAS, the house at 415 Auburn Street. has been assessed by the County
Assessor at $88,350; and
WHEREAS, the City wishes to pay the owner of 415 Auburn the assessed value of
the property, less $17,719 that the State Otlice of Emergency Services has determined to be
duplication of benefit payments; and
WHEREAS, the owner of 415 Auburn Street, Mrs. Jo Ann Loggains, has accepted
the City's offer to purchase the property for $70,631 and the City will pay all closing costs;
and
WHEREAS, the City of West Memphis will demolish the house to remove it as a
future potential repetitive flood loss in accordance with FEMA's Hazard Mitigation Grant.
Program and will maintain the property as perpetual open space;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the purchase of the property at 415
Auburn Street, and the owner Mrs. Jo Ann Loggains be paid $70,631 for the
property, and the City of West Memphis will pay all closing costs.
2. That the agreement between the City of West. Memphis and Mrs. Jo Ann
Loggains is hereby approved and the Mayor and the City Clerk are hereby
authorized to execute the necessary purchase contract.
