A RESOLUTION CERTIFYING THE CONDEMNATION AND REMOVAL OF
HOUSES,BUILDINGS AND/OR RESIDENTIAL STRUCTURES
CONSTITUTING A NUISANCE WITHIN THE CITY OF WEST MEMPHIS
CORPORATE LIMITS.
WHEREAS,Chapter 12.64 of the West Memphis Municipal Code provides a.procedure
for the City Council to condemn any house, building and/or structure which constitutes a
nuisance by adoption of a resolution setting out a description of the house, building or structure,
the name or names, if known, of the owners thereof, and the reason or reasons said house,
building and/or structure is or has been condemned as a nuisance; and
WHEREAS,.provided in Chapter 12.64 of West Memphis Municipal Code, notice of the
condemnation of the house, building and/or structure is to be provided by mailing a certified
copy of the resolution to.the owner or owners if their whereabouts are known or to their last
known address and by posting a copy of the resolution at a conspicuous place on said house;
building and/or structure, and if the whereabouts or last known address are'unknown the posting
of the resolution will suffice as notice; and
WHEREAS.,provided.in Chapter.12.64 of West Memphis Municipal code, the house,
building and/or structure constituting a nuisance will be torn down and/or removed by the
building inspector or-his duly designated representative if it has not been torn down and
removed, or said nuisance otherwise.abated within thirty (30) days after posting the true copy of
the resolution at a conspicuous place on said house, building and/or structure constituting a
nuisance; and
WHEREAS,if'the City has any net costs in removal of any house,building or structure,
the City shall have a lien placed on the property;
NOW, THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS,THAT, the houses, buildings and/or structures
described in Attachment "A" attached hereto and incorporated herein by reference are hereby
declared to be a nuisance for the reason or reasons therein set forth.
BE IT FURTHER RESOLVED THAT, if the house, building and/or structure
constituting a nuisance has not been torn down and removed or the nuisance otherwise abated
within(3O) days of the posting of a true copy of this resolution in a conspicuous place on said
house, building and/or structure,the building inspector or his.duly designated representative is
authorized and directed to tear down and/or remove the house, building and/or structure
constituting a nuisance.and to cause a lien to be placed on the property for any net costs incurred
by the city for the removal of said house, building and/or structure.
