ORDINANCE NO. 1
AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE
PROPERTY LOCATED AT 1105 BALFOUR., PERMITTING A 150 ft. TALL
COMMUCATIONS TOWER IN A R-1 SINGLE FAMILY RESIDENTIAL
DISTRICT.
WHEREAS, application has been made to the City Planning Commission, on
July 29, 2020, for a Special Use Permit allowing a Communications Tower, in a R-1,
Single Family Residential District, as required by Ordinance No. 1988, as amended.
WHEREAS, after notice had been published for the time and in the manner as
provided by Ordinance No. 1988, as amended, the matter was heard by the City Planning
Commission on Wednesday, July 29, 2020, and the Planning Commission recommended
approval of a Special Use Permit for a Communications Tower at 1105 Balfour Rd.,
located in a R-1, Single Family Residential District, with the following criteria:
1. In accordance with the attached Site Plan.
2. Federal Aviation Administration appriXal of the height of the tower
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS ARKANSAS:
SECTION 1: The following described property, to wit:
1105 BALFOUR ROAD
Lot 1-A, Block 1 North Richland 1St Addition
and the same hereby is granted a Special Use Permit for a Communications
Tower at 1105 Balfour Rd., located in a R-1, Single Family Residential District, with the
following criteria:
1. In accordance with the attached Site Plan.
2. Federal Aviation Administration approval of the height of the tower
SECTION 11: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
