1813RESOLUTION NO. ~ ~ ~ 3 A RESOLUTION CERTIFYING THE CONDEMNATION ANI) REMOVAL OF HOUSES, BUILDINGS AND/OR RESIDENTIAL STRUCTURES CONSTITUTING A NUISANCE WITHIN THE CITY OF WEST MEMPHIS CORPORATE LIMITS. WHEREAS, Chapter 1 x.64 of the West 1Vlemphis 1Vlunicipal Code provides a procedure for the City Council to condemn any house, building and/or structure which constitutes a nuisance by adoption of a resolution setting out a description of the house, building or structure, the name or names, if known, of the owners thereof, and the reason or reasons said house, building andlor structure is or has been condemned as a nuisance; and W IiEREAS, as provided in Chapter 12.64 of West Memphis Municipal Code, notice ofthe condemnation ofthe house, building and/or structure is to be provided by mailing a certified copy of the resolution to the owner or owners if their whereabouts are known or to their last known address and by posting a copy ofthe resolution at a conspicuous place on said house, building and%or structure, and if the whereabouts or last known address are unknown the posting of the resolution will sui~ice as notice; and WHEREAS, as provided in Chapter 12.64 of West 1Vlemphis Municipal code, the house, building and/or structure constituting a nuisance will be torn down and/or removed - ;_. by the building inspector or his duly designated representative if it has not been torn down and removed, or said nuisance otherwise abated within thirty (30 j days ai~er posting the true copy of the resolution at a conspicuous place on said house, building andJor structure constituting a nuisance; and WHEREAS, if the City has any net costs in removal of any house, building or structure, the City shall have a Lien placed on the property; NOW, THEREFORE, BE I`T RESOLVED BY 'THE (,"ITY COUNCIL OF THE Cl1'Y OF WEST 1V1EM1'I1S, ARKANSAS, THAT the houses, buildings and/or structures described in 1/xhibit "A33 attached hereto and incorporated herein by reference are hereby declared to be a nuisance for the reason or reasons therein set forth. Resolution No. page two BE 1'1` N Uli`11Elt tL50LVED '1`1A'1` if the house, building and/or structure constituting a nuisance has not been torn down and removed or the nuisance otherwise abated within thirty (30) days of the posting of a true copy of this resolution in a conspicuous place on said house, building and/or structure, the building inspector or his duly designated representative is authorized and directed to tear down and/or remove the house, building and%or structure constituting a nuisance and to cause a lien to be placed on the property for any net costs incurred by the city for the removal of` said house, building and/or structure.
