A RESOLUTION AUTHORIZING THE REMOVAL OF A LIEN FOR GRASS
CUTTING SERVICES PERFORMED BY THE CITY OF WEST MEMPHIS.
WHEREAS, Resolution 1757 adopted by the West Memphis City Council certified
charges to be placed as a lien against certain property within the City of West Memphis, including
that property located at 729 E. McAuley Street, for grass cutting services performed by the City
of West Memphis pursuant to Ordinance 1385; and
WHEREAS, Resolution 1757 certified charges of $86.96 to be placed as a lien against
the property owned by James M. and Kathy A. Howell at 729 E. McAuley Street in West
Memphis for grass cutting; and
WHEREAS, it has come to the attention of the Code Enforcement Office that the lien of
$86.96 placed against the property at 729 E. McAuley Street in West Memphis was placed on the
tax books after ownership of the real property had been transferred to anew owner without
notice of the City's claim after the grass cutting and before the imposition of the lien; and
WHEREAS, it is the recommendation of the Code Enforcement Office that the lien of
$86.96 placed against the property located at 729 E. McAuley in West Memphis by Resolution
1757 be removed;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
The lien imposed by Resolution 1757 pursuant to the authority of Ordinance 1385 against
the property owned by James M. and Kathy A. Howell at 729 E. McAuley Street in West
Memphis, Arkansas, is hereby authorized to be removed;
2. The Code Enforcement Office is directed to forward a copy of this Resolution to the
Crittenden County Tax Collector's Office and to the property owner.
