RESOLUTION AND AMENDMENT TO
MONEY PURCHASE PENSION PLAN FOR NON-UNIFORM EMPLOYEES OF THE
CITY OF WEST MEMPHIS
WHEREAS, The City of West Memphis (hereinafter called the Employer) established
the Money Purchase Pension Plan for the Non-Uniform Employees of the City of West
Memphis (hereinafter called the Plan) effective as of January 1, 1989; and
~,;, WHEREAS, the Employer desires to reduce the number of Entry Dates for Employees
that have met the eligibility requirements of the Plan; and
WHEREAS, the Employer desires to limit the frequency of in-service withdrawals of
amounts accumulated in a Participant's Voluntary Account.
WHEREAS, Section 3.10.1 of the Plan allows the Employer to amend the Plan without
jeopardizing the qualified status of the Plan;
NOW, THEREFORE, BE IT RESOLVED that, effective upon execution, the
Employer amends the Plan to replace the selection in Section 1.2.28 of the Plan Document in
its entirety with the following:
1.2.28. Entry Date -The first day of the Plan Year or the date six (6) months thereafter,
coincident with or next following satisfaction of the eligibility requirements. Eligibility
requirements are defined in Section 2. l.l.
BE IT FURTHER RESOLVED that, effective upon execution, the Employer amends the Plan
~` to replace the selection in Section 2.5.8 of the Plan Document in its entirety with the
~' following:
2.5.8. In Service Distributions - A Participant shall be entitled to an in service distribution of
his Voluntary Account only , by filing a written request with the Plan
