AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR REPAIR OF THE SINKHOLE AT 300
SHOPPINGWAY BLVD, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive bidding in
exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS,there are many items necessary for they City's use where competitive bidding is
deemed not feasible or practical; and
WHEREAS,the City of West Memphis is in need of having repairs made to a sinkhole at 300
Shoppingway Blvd., to excavate and replace damaged drainage structures, and to restore the site to its
previous condition; and
WHEREAS, unrepaired sinkholes tend to grow quickly and may cause additional damage to City
infrastructure and the surrounding property; and
WHEREAS, Crisp Contractors Inc. has been on-site assisting with the engineering evaluation and
repairs needed; and
WHEREAS, Crisp Contractors Inc. has provided a cost estimate, and is a local firm that can
mobilize to the site immediately;
NOW,THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS,
ARKANSAS:
1. That competitive bidding be waived for the following item to be used by the City, described as
follows:
Remove and replace corrugated metal pipe, reinforced concrete pipe, and PVC pipe, remove
and haul off excess soil and concrete pavement, reinstall trench box, backfill sinkhole area,
replace curb and gutter, construct stone base and asphalt surface course to restore site to
previous condition.
2. EMERGENCY CLAUSE. It having been found by the City Council of the City of West Memphis,
Arkansas, that the repairs to the sinkhole at 300 Shoppingway Blvd. are necessary in order to
prevent further damage and remove a safety hazard and that there is an urgent and immediate
need for said repairs to be completed, an emergency is hereby declared to exist, and this
Ordinance being necessary for the preservation of the public peace, health, safety, and welfare
of the Citizens of West Memphis, Arkansas, shall be in full force and effect from and after the
date of its passage and approval.
