ORDINANCE NO. 2J
AN ORDINANCE TO REPEAL ORDINANCE 1988,AS AMENDED,AND ADOPT A
NEW COMPREHENSIVE ZONING TEXT AND ZONING MAP,AND FOR OTHER
PURPOSES
WHEREAS,in 2001 the City of West Memphis adopted Ordinance 1988, which adopted
zoning regulations and an official zoning trap for the City of West Memphis; and,
WHEREAS,over the years, this Ordinance has been amended numerous times: and
WHEREAS,the West Memphis Planning Commission has prepared a new,
comprehensive "Zoning Text and Zoning Map"which it recommends for approval, consisting of
ten articles of narrative text and one map, in accordance with the provisions of A.C.A. §14-56-
412, to replace 1988;and,
WHEREAS,the West Memphis Planning Commission has conducted a public hearing
on Wednesday,September 29, 2021,in order to seek citizen review and comment prior to the
adoption of said Zoning Text and Zoning Map; and
WHEREAS,no fewer than three(3) copies of said Zoning Text and Zoning Map are on
file in the office of the City Clerk in the West Memphis City Hall, and will continue to be on file
at all times for public inspection and review; and
WHEREAS,the West Memphis Planning Commission desires to repeal Ordinance 1988
and to adopt said Zoning Text and Zoning Map in order to guide and influence the allocation and
arrangement of Ind uses, the development of land and the future buildings within the corporate
limits of the city.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS,ARKANSAS:
SECTION 1: The Zoning Text, consisting often articles of narrative text,and the Zoning
Map titled"Official Zoning Map," as recommended by the West Memphis Planning
Commission, is adopted and approved in all respects as an instrument to guide and influence the
allocation and arrangement of land uses, the development of land,and the future buildings within
the corporate limits of the city.
SECTION 2:The City Council does adopt byreference, pursuant to Arkansas Statutes
19-2421,public notice having been duly given and three copies of the regulations have been and
presently are duly filed with the City Clerk for inspection and review by the public, being a
printed document dated September, 2021 consisting of narrative text and one map marked as the
"Official Zoning Map", and the same are adopted and incorporated herein and as an ordinance
as fully as if set forth at length herein, and from the date on which the ordinance shall take effect,
the provisions therein shall be controlling zoning matters and matters pertinent thereto within the
city.
SECTION 3: On the date on which this Ordinance shall take effect,Ordinance No. 1988
shall be repealed in its entirety, having been replaced by the new zoning text and zoning map.
SECTION 4:All ordinances or parts of ordinances in conflict with this Zoning Text and
Zoning Map, or inconsistent with provisions of this Ordinance, are hereby repealed to the extent
necessary to give this Zoning Text and Zoning Map full force and effect upon its adoption by the
City Council of the City of West Memphis, Arkansas. ,/
