AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE
PROPERTY LOCATED NORTH OF INTERSTATE 40 ADJACENT TO
ARKANSAS HIGHWAY 147,CRITTENDEN COUNTY ROAD 175,AND
ARKANSAS HIGHWAY 50,PERMITTING A SOLAR PHOTOVOLTAIC
GENERATION FACILITY AND ASSOCIATED TRANSMISSION LINES,IN
THE CONSERVATION EXTRA-TERRITORIAL(CV-E) DISTRICT.
WHEREAS,an application has been made to the City Planning Commission, on
September 22, 2021, for a Special Use Permit allowing a solar photovoltaic generation
facility and associated electricity transmission lines(collectively,the"Generation and
Transmission Facilities"), in a CV-E, Conservation Extra-Territorial District, as required
by Ordinance No. 1988, as amended.
WHEREAS, after notice had been published for the time and in the manner as
provided by Ordinance No. 1988,as amended,the matter was heard by the City Planning
Commission on Tuesday, October 12,2021 and the Planning Commission recommended
a Special Use Permit be granted to allow the Generation and Transmission Facilities on
the property described in Section 1 below located generally north of Interstate 40
adjacent to Arkansas Highway 147, Crittenden County Road 175, and Arkansas Highway
50, located in a CV-E, Conservation Extra-Territorial District.
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF
L THE CITY OF WEST MEMPHIS ARKANSAS:
SECTION 1: The following described property, to wit:
-Solar generation facility located within the SW '/. of Section 1, and the
West %2 of Section 12, Township 6 North,Range 7 East,within the West
Memphis Extraterritorial Jurisdiction and the 500- foot use permit area,
Crittenden County, Arkansas.
-The transmission connection line falls within part of the East 1/2 of the
West 1/2 of Section 1,Township 6 North, Range 7 East,and part of the
South 1/2 of the SW '/4 of Section 36,Township 7 North, Range 7 East,
within the West Memphis Extraterritorial Jurisdiction in Crittenden
County,Arkansas.
and the same hereby is granted a Special Use Permit allowing the Generation and
Transmission Facilities located in a CV-E, Conservation Extra-Tentorial District. The
Generation and Transmission Facilities shall be deemed a public utility structure under
Article IV, Section 2B of Ordinance No. 1988.
SECTION 2: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed.
