Upon voice vote, voting was unanimous to approve. OLD BUSINESS: 3rd READING OF AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR 312 SHADY GROVES, PERMITTING A GREENHOUSE IN A R-2 LOW DENSITY RESIDENTIAL DISTRICT City Attorney Stephenson read the ordinance by title only for the THIRD and FINAL TIME. Council Member Harris made motion, seconded by Council Member Hutchinson to approve the ordinance. Discussion followed: Council Member Croom expressed concern with approving the ordinance since the council previously denied another application for a greenhouse. Council Member Mohammed asked what would be grown in the greenhouse and how it would benefit the community. The applicant Mrs. Pricilla Tillisford a resident of 306 Shady Grove West Memphis, Arkansas addressed council and said that she has applied to the Department of Agriculture for a grant for the greenhouse. Mrs. Tillisford said she plans to grow vegetables, fruit trees and plants. Council Member Mohammed asked if there would be a cost or would it be free to the community. Mrs. Tillisford said that it would not be free, and the greenhouse would be a business. Council Member Catt said he had gone by the property to look at the area and his only concerns was the road could not handle a business because of the narrow streets but if all she was going to do is grow vegetables and then sale off site, he did not see an issue. Planning & Development Director, Paul Luker said the application before council was for a special use permit not permission to operate a business. Mr. Luker said Mrs. Tillisford does not live on the property and she could not operate as a business or sale from the property and so long as they do not get any complaints, she would be ok. Council Member Holt said that he represents the ward where Mrs. Tillisford lives and unlike the previous application for a greenhouse, he has not received any opposition. Ms. Louisa Moss a resident of 977 Gaylon Southaven, Mississippi came before council. Ms. Moss owns the property at 308 Shady Grove. Ms. Moss said that she had no previous knowledge of the greenhouse and only became aware of it when she came to check her property and found that all her trees had been cut down. Ms. Moss said she is not opposed to the greenhouse but was concerned that the trees at her property were cut down without her knowledge or permission. Ms. Tillisford said that she had some trees cut on her own property but had no knowledge of who cut the trees on Ms. Moss property. Ms. Moss is asking that due diligence be done to assure that her property is not disturbed and would like a land survey to be done to mark her property line. Council Member Croom deferred to City Attorney Stephenson for his guidance if there could be possible legal issues because they denied the previous application. City Attorney Stephenson said he did not believe so since there were other issues with the subdivision and opposition in the other case and he did not believe it was the same. Council Member Mohammed wanted to wait to see if the Department of Agriculture would approve her application. Mrs. Tillisford said that regardless of if the Department of Agriculture approved her application that her plan is to move forward even if she must pay for it. Council Member Hutchinson asked for confirmation that Ms. Tillisford will not be operating a business for profit and will sale her vegetables off site. There being no further discussion: Mayor McClendon asked for a roll call vote. City Clerk, James Pulliaum called the roll. The roll call vote was as follows: YES: Catt, Harris, Holt, Hutchinson, Mondy, Murray, NO: Croom, Wheeless ABSTAIN: Mohammed ABSENT: None With 6 yes votes, 2 no votes, 1 Abstention vote, and 0 absent voters. The ordinance PASSED. The ordinance was adopted and assigned No. 2570. 3RD READING OF AN ORDINANCE TO AMEND SECTION 38-45 OF THE WEST MEMPHIS MUNICIPAL CODE FOR THE PURPOSE OF LEVYING AN ADDITIONAL ONE PERCENT (1%) TAX FOR A TOTAL OF THREE PERCENT (3%) UPON THE GROSS RECEIPTS OR GROSS PROCEEDS FROM THE RENTAL OF CERTAIN ACCOMODATIONS AND THE SALE OF PREPARED FOODS AND BEVERAGES AS AUTHORIZED BY A.C.A. SECTION 26-75-602, AND FOR OTHER PURPOSES City Attorney Stephenson read the ordinance for the THIRD and FINAL time by title only. Council Member Monday made the motion, seconded by Council Member Murray to approve the ordinance. Discussion followed: Council Member Catt said during the budget meeting administration made several cuts especially in general funds with the intent to wait until business could reopen at 100% and people getting their jobs back. When the ordinance was read at the last council meeting plans were to schedule a meeting with the public and he is not in favor of waiting to pass the ordinance only after they have had the opportunity to meet to brainstorm ideas. One of the problems they have is bringing people to the community that will be spending money and staying in that will be spending money and staying in the hotels. Council Member Catt said he would like to wait and meet and brainstorm some ideas and revisit this later. Council Member Croom agreed with Council Member Catt and felt this was not the right time and felt that council should table this matter indefinitely. Council Member Holt said he has been indecisive about this matter for a while but felt that there is a need to improve the parks and by hiring an individual to assist the parks director to improve the parks would be good. The state parks will be opening back up in June and some of the restaurants are already opening and he feels it will be good for the economy. Council Member Mohammed said she is not opposing the ordinance because she knows that the city must generate money to make improvements she asked if the record would reflect that the money would go exclusively to the parks. Mayor McClendon said it would be going to Advertising & Promotion and the money in general funds would not have to be used to fund the parks. 69% of the budgeted money in general funds will help fund the police, fire, and EMS. Mayor McClendon said in accordance with AR 14-43-502 section (b) which states council shall have management and control of funds. Mayor McClendon said he respects the council's role in the budget process but as CEO of the city it is his duty and obligation to offer solutions that will take the city from where they are today to where they need to be in the future and to do it responsibly and to present these matters to council. Mayor McClendon said that sometimes they must take bold and necessary and sometimes unpopular measures to do what is right for the city and the cities future this is one of those times and it is his and councils judiciary responsibility to do so. Mayor McClendon said over the past several months he has solicited recommendations from council on ways to improve the general funds revenue. The 1%A & P tax will have the least amount of impact on the citizens of West Memphis and part of their responsibility as leaders is to make tough and responsible choices based on the current information at hand. Mayor McClendon said that is what leadership is and moving and adjusting to the demands of time is why they were all elected to just say no without a solution would be pointless. Mayor McClendon presented his "Invest in Our Future Plan" to the council.: There being no further discussion: Mayor McClendon asked for a roll call vote. City Clerk, James Pulliaum called the roll. The vote was as follows: YES: Harris, Holt. Hutchinson, Mohammed, Mondy, Murray NO: Catt, Croom, Wheeless ABSTENTION: None ABSENT: None With 6 yes votes, 3 No votes, 0 Abstention votes, 0 absent votes the ordinance PASSED The ordinance was adopted and assigned No. 2571. Council Member Mohammed passed out a list of improvements identified for the Parks renovations to the council. Council Member Catt asked that council meet to discuss a long-term solution rather than a short-term solution in the future that will give the city a long- term revenue source and come up with a plan to bring more people to the community. Council Member Harris said that it is going to take everyone coming together in agreement to come up with a plan. Council Member Harris said the reason that we have maintained one of the lowest utility rates today is because council voted to raise the utility rates over 15 years ago. NEW BUSINESS: Council Member Mohammed made the motion, seconded by Council Member Holt to read R-1, 0-1, and 0-2 by title only. Upon voice vote, the voting was unanimous. R-1 A RESOLUTION BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF WEST MEMPHIS OPPOSING THE STAND YOUR GROUND" LAW AND REQUESTING GOVENOR ASA HUTCHINSON NOT TO SIGN THE "STAND YOUR GROUND" BILL City Attorney Stephenson read the resolution by title only. Council Member Catt said it was his understanding that Governor, Asa Hutchinson had already signed the bill. Council Member Catt made the motion, seconded by Council Member Croom to table the resolution indefinitely. Upon voice vote, voting was unanimous. Tabled Indefinitely. 0-1 AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR AEIRAL SPARAYING, GROUND SPRAYING AND OTHER MOSQUITO CONTROL EFFORTS, AND FOR OTHER PURPOSES City Attorney Stephenson read the ordinance by title only for the FIRST time by title only. Council Member Catt made the motion, seconded by Council Member Croom to suspend the rules, and place the ordinance on its second reading. Upon voice vote, voting was unanimous. City Attorney Stephenson read the ordinance for the SECOND time by title only. The ordinance will be read for the third time at the March 18, 2021 council meeting. 0-2 AN ORDINANCE AUTHORIZING THE SENIOR DEPUTY CITY CLERK TO ATTEST THE MAYOR'S SIGNATURE WHEN HE/SHE HAS RECEIVED WRITTEN COMMUNICATIONS FROM THE ELECTED CITY CLERK, AND FOR OTHER PURPOSES City Attorney Stephenson read the ordinance by title only for the FIRST time by title only. Council Member Catt made the motion, seconded by Council Member Croom to suspend the rules, and place the ordinance on its second reading. Upon voice vote, voting was unanimous. City Attorney read the ordinance for the SECOND time by title only. Mayor McClendon asked the ordinance to be amended to read unless the City Clerk is incapacitated. The ordinance will be read for the third time at the March 18, 2021 council meeting. PERMISSION TO HIRE AN ADMINISTRATIVE ASSISTANT/PARKS COORDINATOR FOR THE PARKS DEPARTMENT Council Member Holt made the motion, seconded by Council Member Harris to approve the parks coordinator position. Discussion followed: Council Member Catt when the 2021 budget was passed there was an open slot for that position close to the amount of pay the Mayor is wanting to pay. Council Member Mohammed asked what was the since of urgency to approve it. Mayor McClendon said even if council approved it today, he would not be looking to hire anyone in the position until they got the parks up and running. Council Member Holt said when the parks department budget was passed the position was included in the budget already and the only thing, he would like to see is that the person considered for the position be experienced. There being no further discussion: Mayor McClendon asked for a roll call vote. City Clerk, James Pulliaum called the role call vote. The vote was as follows: J YES: Catt, Harris, Holt, Hutchinson, Murray, and Mayor McClendon NO: None ABSTENTION: Croom, Mohammed, Wheeless ABSENT: Mondy With 6 yes votes, 0 No votes, 3 Abstention votes and 1 absent vote the vote PASSED.
