AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR MOWING SERVICES AT THE
WEST MEMPHIS AIRPORT AND FOR OTHER PURPOSES
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of competitive bidding in
exceptional situations where such procedure is deemed not feasible or practical; and
WHEREAS, there are many items necessary for the City's use where competitive bidding is deemed
not feasible or practical; and
WHEREAS, the West Memphis Airport Commission had a contract with T. C. Lawn and
Landscape for mowing services dated June 1, 2002; and,
WHEREAS, T. C. Lawn and Landscape has agreed to provide the same services on the same terms
as in the year 2002 for the year 2003, plus any applicable taxes, and competitive bidding under such
circumstances would not be feasible or practical;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
WEST MEMPHIS, ARKANSAS:
1. That competitive bidding be waived for the following item to be used by the City, described as
follows:
Mowing services provided by T. C. Lawn and Landscape at the current base rate of $3,017.50 per
mowing, plus any applicable taxes.

2002 AIRPORT MOWING CONTRACT
FOR THE WEST MEMPHIS MUNICIPAL AIRPORT
The City of West Memphis, Arkansas, (the "City")and the West Memphis
Municipal Airport Commission (the "Commission") seek a qualified vendor to furnish all
labor and equipment necessary and required to provide mowing services for the West
ici al Air ort.

SECTION 1
SCOPE.OF SERVICES
1. The Contractor shall provide all necessary labor and equipment for the proper
and adequate performance and completion of the work, including any items not
particularly mentioned in these specifications, but necessary for the performance of the
work.
2. The area for which services are to be provided includes all areas within the
;jurisdiction of the West Memphis Municipal Airport Commission as more
specifically set out in Exhibit A. Such area may be hereinafter referred to as the
"service area."
3. Length of Agreement. ---
A. Completion of each mowing at the earliest date is a high priority with the
Airport Commission and the City of West Memphis. The Contractar shad be
prepared to start work upon execution of this Contract. Subsequent start
dates shall be at the direction of the Commission or its designated
representative. .
B. Completion of each mowing specified in this Contract shall be within seven
(7) days of the date the Contractor is notified by the Commission's
representative, weather and ground conditions permitting.
C, For purposes of determining a value of the agreement, the Airport
Commission anticipates twenty-two (22) mowings during iM,~ rowtwo s~ son

renew the contract, by mutual agreement betweeen the City and the
Commission and the contractor, for subsequent years. The contract may be
canceled at any time by the City and the Commission with thirty (30) days,
notice to the contractor.
E. Before submitting a Bid proposal, each Bidder shall make all investigations
and examinations necessary to ascertain site conditions and requirements
affecting the full performance of the contract and to verify any
representations made by the City of West Memphis or the West Memphis
Airport Commission upon which the bidder will rely. if the Bidder receives an
award because of its Bid proposal submission, failure to have made such
investigations and examinations will in no way relieve the Bidder from its
obligations to comply in every detail with all provisions and requirements of
the contract, nvr will a plea of ignorance of such conditions and
requirements be accepted as a basis for any claim by the Bidder for
additional compensation or relief.

SPECIFICATIONS
