A RESOLUTION APPROVING A CONTRACT TO SELL REAL ESTATE
FOR HIGHWAY PURPOSES BETWEEN THE CITY OF WEST
MEMPHIS AND THE ARKANSAS STATE HIGHWAY COMMISSION
REGARDING 0.68 ACRES, MORE OR LESS, AND REFERENCED AS
JOB 110358, AND AUTHORIZING THE MAYOR AND CITY CLERK TO
EXECUTE THE CONTRACT ON BEHALF OF THE CITY OF WEST
MEMPHIS.
WHEREAS, the Arkansas State Highway Commission is in need of acquiring title to
0.68 acres, more or less, of real property for Job 110358 involving improvements to be made to
the intersection of Airport Road and Interstate 40; and
WHEREAS, the acquisition of this property by the Arkansas State Highway Commission
will impact certain facilities of the City of West Memphis, specifically facilities located at Tilden
Rodgers Park; and
WHEREAS, the City Council of the City of West Memphis finds that it is in the best
interests of the City of West Memphis and all parties concerned that the Arkansas State Highway
Commission acquire title to the real property referenced in the contract for the purposes of
providing improvements to the intersection of Airport Road and Interstate 40;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
Section 1. The Contract to Sell Real Estate for Highway Purposes between the City of
West Memphis, Arkansas, and the Arkansas State Highway Commission regarding 0.68 acres of
real property, more or less, is hereby approved and, in exchange for the payment of $103,500.00
and such other terms and conditions as may be agreed to by the parties including, but not limited
to, the payment of relocation expenses, the Mayor and City Clerk are hereby authorized to
execute the contract and a Special Warranty Deed, and such other documents as may be
necessary or required, on behalf of the City of West Memphis for the conveyance of the
referenced property.
