A RESOLUTION APPROVING A CONTRACT TO SELL REAL ESTATE
FOR HIGHWAY PURPOSES BETWEEN THE CITY OF WEST
MEMPHIS AND THE ARKANSAS STATE HIGHWAY COMMISSION
REGARDING 5,510 SQUARE FEET, MORE OR LESS, AND
REFERENCED AS JOB 110463, AND A TEMPORARY CONSTRUCTION
EASEMENT, AND AUTHORIZING THE MAYOR AND CITY CLERK
TO EXECUTE THE CONTRACT AND THE TEMPORARY
CONSTRUCTION EASEMENT ON BEHALF OF THE CITY OF WEST
MEMPHIS.
WHEREAS, the Arkansas State Highway Commission is in need of acquiring title to
5,510 square feet, more or less, of real property and a temporary construction easement over
Tract 7E as designated in the Right-of--Way Plans for Job 110463 involving improvements to be
made to the intersection of Airport Road and Interstate 40; and
WHEREAS, the City of West Memphis presently holds title to this specific property as
the result of a bond issue in favor of S-B Power Tools; and
WHEREAS, S-B Power Tools has reviewed the plans of the Arkansas State Highway
Commission and expressed no objection to the Arkansas State Highway Commission acquiring
the property and the temporary construction easement; and
WHEREAS, the City Council of the City of West Memphis finds that it is in the best
interests of the City of West Memphis and all parties concerned that the Arkansas State Highway
Commission acquire title to the real property referenced in the contract as well as the temporary
construction easement for the purposes of providing improvements to the intersection of Airport
Road and Interstate 40;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
Section 1. The Contract to Sell Real Estate for Highway Purposes between the City of

West Memphis, Arkansas, and the Arkansas State Highway Commission regarding 5,510 square
feet of real property, more or less, is hereby approved and, in exchange for the payment of
$4,900.00, the Mayor and City Clerk are hereby authorized to execute the contract and a Special
Warranty Deed, and such other documents as maybe necessary or required, on behalf of the City
of West Memphis for the conveyance of the referenced property.
Section 2. The Temporary Construction Easement over Tract 7E as designated in the
Right-of--Way Plans for Job 110463 is hereby approved and, in exchange for the payment of
$1,450.00, the Mayor and the City Clerk are hereby authorized to execute the Temporary
Construction Easement on behalf of the City of West Memphis.
Section 3. Upon receipt of the payments referenced above, the City of West Memphis
shall process said funds in accordance with the requirements of the bond issue in favor of S-B
Power Tools.
