WHEREAS, there has been filed with the City Council of
the City of West Memphis, Arkansas, by Lee McQueen a petition
to vacate the following part of an easement:
(a) The north five (5) feet of the 10-foot utility
easement that is adjacent to the south property line of Lot 1
in Block 1 of Country Club Gardens, West Memphis, Arkansas, as
shown by plat of record in Plat Book 2 at page 504, in the
office of the Circuit Court Clerk & Ex-Officio recorder of
Crittenden County, Arkansas with a physical address of 301
Tournament Road.
NOW, THEREFORE, BE IT RESOLVED:
That said petition to vacate the portion of the above
described easement in the City of West Memphis, Arkansas, be
set down for hearing on the 19th day of February, 1998, at
1:30 p.m. at the City Council Chambers in the City of West
Memphis, Arkansas, and that the City Clerk give notice as
required by law of the hearing to be held.

PETITION TO VACATE PORTION OF EASEMENT
Comes the Petitioner, Lee McQueen being one of the owners
of Lot 1, Block 1 Country Club Gardens, West Memphis,
Arkansas, as shown by plat of record in Plat Book 2 at page
504, said plat appearing of record in the office of the
Recorder of Crittenden County, Arkansas, which lands touch
upon the easement sought to be vacated and petitioning the
City Council of the City of West Memphis, states:
That Petitioner is seeking to vacate the following
portion of easement:
(a) The north three (3) feet of the 10-foot utility
easement that is adjacent to the south property line of lot 1
in block 1 of Country Club Gardens, West Memphis, Arkansas, as
shown by plat of record in Plat Book 2 at page 504, in the
office of the Circuit Court Clerk & Ex-Officio recorder of
Crittenden County, Arkansas with a physical address of 301
Tournament Road.
That the General manager of West Memphis Utility has
agreed to abandon the above described easement and Petitioner
now requests the closing of the above described.
That there is attached hereto as Exhibit "A" a copy of
the survey and plat filed for record in the office of the
Recorder of Crittenden County, Arkansas, which shows the
portion of the easement to be vacated together with the lands
abutting upon the easement to be vacated.
WHEREFORE, Petitioner prays that the City Council of the
City of West Memphis, Arkansas at its next regular or special
meeting, give notice of such hearing as required by law and
that upon the final hearing the portion of the easement as
aforesaid be vacated and all rights of the City of West
Memphis and of the public generally be released, vacated and
abandoned.
