A RESOLUTION TO APPROVE AN AGREEMENT BETWEEN THE
CITY OF WEST MEMPHIS AND NETWORK PROBATION OF
AMERICA INC. TO PROVIDE SERVICES TO THE WEST MEMPHIS
MUNICIPAL COURT AND FOR OTHER PURPOSES
WHEREAS, pursuant to A. C. A. § 16-17-127, a municipal court, upon
approval of the governing body exercising control over the municipal court, is authorized
to contract with a person for the person to provide services including probation services,
pretrial supervised release programs, and alternate sentencing programs; and
WHEREAS, Network Probation of America Inc., has proposed to provide
probation services, pretrial supervised release programs, and alternative sentencing
programs far the West Memphis Municipal Court; and
WHEREAS, the availability of such programs and services will increase the
sentencing options available to the West Memphis Municipal Court and the
administration of justice at no additional expense to the City of West Memphis; and
WHEREAS, the Gity Council of the City of West Memphis finds the agreement
between the City of West Memphis and Network Probation of America Inc., to be in
the best interests of the City of West Memphis and the Mayor and the City Clerk should
be authorized to execute the agreement on behalf of the City of West Memphis;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCII. OF THE
CITY OF WEST MEMPHIS, ARI{ANSAS, THAT the agreement between the City of
West Memphis and Network Probation of America Inc., is hereby approved and the
Mayor and the City Clerk are hereby authorized to execute the agreement on behalf of
the City of West Memphis.

AGREEMENT
This agreement is entered into on the day of ,
19 , by and between the City of West Memphis and Network Probation of America,
Inc.,:
WHEREAS, A. C. A. § 16-17-127 authorizes a municipal court to contract
with a person to provide services to the court including probation services, pretrial super-
vised release programs, and alternate sentencing programs upon approval of the
governing body exercising control over the municipal court; and
WHEREAS, the West Memphis Municipal Court desires to contract with
Network Probation of America Inc., to provide such services; and
WHEREAS, Network Probation of America Inc., desires to provide such

services to the West Memphis Municipal Court, the parties hereto agree as follows:
1. Network Probation of America Inc., agrees to provide services to the West
Memphis Municipal Court to include probation services, pretrial supervised release
programs, and alternate sentencing programs;
2. Network Probation of America Inc., agrees to provide any and all reports to
the West Memphis Municipal Court regazding individuals that have been placed under its
supervision;
3. Network Probation of America Inc., agrees to indemnify and hold harmless
the City of West Memphis and the West Memphis Municipal Court from any and all
claims or other causes of action arising out of or related to the services provided by it to
the West Memphis Municipal Court.
4. Network Probation of America Inc., agrees to comply with all requirements

of A.C.A. § 16-17-127 and all other applicable laws of the State of Arkansas regarding
the services to be provided to the West Memphis Mumcipal Court;
5. Network Probation of America Inc., agrees that any probation fee or public
service work supervisory fee that any defendant may be required to pay shall be in an
amount to be established by the municipal court as authorized by A. C. A. § 5-4-322;
6. The City of West Memphis agrees to authorize the West Memphis Municipal
Court to place individuals under the supervision of Network Probation of America Inc.,
subject to the discretion of the judge of the West Memphis Municipal Court;
7. The parties agree that this agreement shall not be exclusive and that nothing
contained herein shall limit the sentencing options available to the West Memphis
Municipal Court;
8. The parties agree that this agreement may be terminated by either party by
giving thirty (30) days notice to the other party.
