WHEREAS, there has been filed with the City Council of
the City of West Memphis, Arkansas, by Jewell I. Wilson and
Grace T. Magie, a petition to vacate the following street:
a) All that portion of Cox Avenue which lies east and

adjacent to the north 50 feet of Lot 78, all of Lot 93, Eighth
Street, Lot 94 and Lot 109 of Hulbert Heights Subdivision to
the City of West Memphis as shown by plat recorded in Plat
Book 1, at page 40 in the Clerk's Office of Crittenden County,
Arkansas. All of the above described property is located in
the west 720 feet of the SE 1/4 of Section 13, T-6-N, R-8-E,
Crittenden County, Arkansas.
and said petitioner prays that the City Council fix a day for
the hearing on said petition:
NOW, THEREFORE, BE IT RESOLVED:
That said petition to close the above described street in
the City of West Memphis, Arkansas, be set down for hearing on
the 3~d day of ~¢~eMlper~ 1998, at 1:30 p.m. at the City
Council Chambers in the City of West Memphis, Arkansas, and
that the City Clerk give notice as required by law of the
hearing to be held.

PETITION TO VACATE STREET
Come the Petitioners, Jewell I. Wilson and Grace T.
Magie, being the sole owners of a portion of Cox Avenue which
lies east and adjacent to the North 50 feet of Lot 78, Eighth
Street, Lot 94 and Lot 109 of Hulbert Heights Subdivision to
the City of West Memphis as shown by plat recorded in Plat
Book 1, at page 40. Said plat appearing of record in the
office of the Recorder of Crittenden County, Arkansas, which
lands abut upon the portions of the street sought to be
vacated and petitioning the City Council of the City of West
Memphis, states:
That Petitioners are seeking to vacate the following
street:
a) All that portion of Cox Avenue which lies east and
adjacent to the north 50 feet of Lot 78, all of Lot 93, Eighth
Street, Lot 94 and Lot 109 of Hulbert Heights Subdivision to
the City of West Memphis as shown by plat recorded in Plat
Book 1, at page 40 in the Clerk's Office of Crittenden County,
Arkansas. All of the above described property is located in
the west 720 feet of the SE 1/4 of Section 13, T-6-N, R-8-E,
Crittenden County, Arkansas.
That said street as depicted on said plats were never
actually laid out and improved as such street and Petitioner
now requests the closing of the portions above described.
That there is attached hereto as Exhibit "A" a copy of
the plat filed for record in the office of the Recorder of
Crittenden County, Arkansas, which shows the portion of the
street to be vacated together with the lands abutting upon the
street to be vacated.
WI,tEREFORE, Petitioner prays that the City Council of the
City of West Memphis, Arkansas at its next regular or special
meeting, give notice of such hearing as required by law and
that upon the final hearing that portion of Cox Avenue which
lies east and adjacent to the north 50 feet of Lot 78, all of
Lot 93, Eighth Street, Lot 94 and Lot 109 of Hulbert Heights
Subdivision as aforesaid be vacated and all rights of the City
of West Memphis and of the public generally be released,
vacated and abandoned, subject only to existing utility
easements.
