BE IT RESOLVED BY THE CITY OF WEST MEMPHIS, (N GRITTEND
COUNTY, ARKANSAS, A RESOLUTION ENTITLED;
A RESOLUT{ON ACCEPTINt3 THE LOCATION, MODIFICATION,
AND EXPANSION 4F THE CRITTENDEN COUNTY SANITARY
LANDFILL (PERMIT #245-S) LOCATED WEST OF THE CITY OF
WEST MEMPHIS.
A RESOLUTION EXPRESSING THE SUPPORT OF THE CITY OF
MEMPHtS, ARKANSAS, FOR THE FOLLOWING:
WHEREAS, the Clty of West Memphis, Arkansas, {hereinafter referred
as City) acknowledges the fact that Crittenden County owns and operet~
a Class (Sanitary Landfill in Crittenden County, Arkansas, located on
98.68 acre tract of land lying in the Southeast Quarter {SE 1!a) of Secti~
17, T-6-N, R-B-E. The existing landfill currently operates In accordan
with Solid Waste Permit # 245-5, originally issued by the Arkans
Department of Pollution Control and Ecology in January of 1988.
WHEREAS, Crittenden County wishes to expand the existing lane
operations to consider a mare efficient utiiization of the existing permiti
area while designating specific areas for yard waste composting and Cia
4 waste (construction and demolition debris) disposal. The modificat
also includes provisions for a solid waste processing facility which
intended to extend the useful life of the facility. Pursuant to Arkan:
Regulation 22, the tacil(ty will continue to only non-hazardous househc
commerc(a1, and industrial solid waste as defined by Regulation 22; s
smell quantities of conditionally exempt hazardous wastes.
WHEREAS, in accordance with A.C.A. 8-6-~ 501 and Arkansas Reguiat
22.205, the City hereby acknowledges the fact tha# a rebutta
presumption exists against permitting the construction or operation of
new landfill within twelve miles of any existing high-impact so(Id wa
facility, or permitting an expansion of the permitted iandflti capacity of
existing landfill.
WHEREAS, the City of West Memphis, Arkansas is the nee
governmental unit, as measured along the major facility access roads
,,,,~ highways, possessing zoning authority encompassed with a twelve•
radius of the referenced facility.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF WEST MEMPHIS,
ARKANSAS,
THAT, the City of West Memphis, Arkansas, hereby resolves to accept the
location, modification, and expansion of the proposed Class I and Class IV
Landfill as proposed by Crittenden County as allowed in Regulation 22.205
(a) (2) for providing convenient and economical waste disposal for the City,
County, and surrounding communities.
