A RESOLUTION AUTHORIZING THE SALE OF CERTAIN CITY
PROPERTY TO THE ARKANSAS HIGHWAY COMMISSION AND FOR
OTHER PURPOSES.
WHEREAS, the Arkansas State Highway Commission is preparing to widen Highway 77
between West Memphis and Marion; and
WHEREAS, the West Memphis Utility Commission owns property for a sewer pumping
station adjacent to the Highway 77 improvements; and
WHEREAS, the Arkansas State Highway Commission wishes to purchase additional
right-of--way across the sewer pumping station for $1,075.00; and
WHEREAS, the West Memphis Utility Commission does not need the property along the
highway which is required by the Arkansas State Highway Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT:
SECTION 1. The sale of the following property described as:
Part of the Northwest Quarter of the Northwest Quarter of Section 6, Township 6 North, Range
9 East, Crittenden County, Arkansas, more particularly described as follows:
Starting at the Southeast Corner of the Northwest Quarter of the Northwest Quarter of Section 6;
thence South 89° 20' 11" West along the South line thereof a distance of 394.829 meters to a
point on the Easterly existing right of way line of State Highway 77; thence North 00° 27' 34"
West along said existing right of way line a distance of 222.714 meters to the point of beginning;
thence continue North 00° 27' 34" West along said existing right of way line a distance of 18.148
meters to a point; thence North 89° 18' 12" East a distance of 6.225 meters to a point on the
Easterly proposed right of way line of State Highway 77; thence South 00° 27' 37" East along
said proposed right of way line a distance of 18.130 meters to a point; thence South 89° 08' 24"
West a distance of 6.225 meters to the point of beginning and containing 0.011 hectare or 113
square meters more or less.
to the Arkansas State Highway Commission for $1,075.00 is hereby approved and the Mayor and
City Clerk are hereby authorized to execute any and all necessary documents relating to the sale
of said property on behalf of the City of West Memphis.
SECTION 2. The Temporary Construction Easement granting the Arkansas State
Highway Commission the right to enter on the property of the City of West Memphis for $250.00
as set out in the Right of Way Plans for Job No. 110303, and designated as Tract No. 6E, is
hereby approved and the Mayor and City Clerk are hereby authorized to execute said document
on behalf of the City of West Memphis.
SECTION 3. All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of any such conflict.
