AN ORDINANCE GRANTING A SPECIAL USE PERMIT ON LOT 6 OF
MCCARLEY SUBDIVISION FIRST ADDITION TO THE CITY OF WEST
MEMPHIS ARKANSAS (4201 PETRO ROAD) FOR THE CONSTRUCTION
OF A 175 FOOT TALL COMMUICATION TOWER
WHEREAS, application has been made to the City Planning Commission to allow
a Special Permitted Use of 175 foot tall communications tower along with 2 (two)
prefabricated 4'4" x 2'4" equipment cabinets and 1 (one) 2'x2' protection cabinet in a I-1
Industrial District, as required by Ordinance 1258 as amended.
WHEREAS, after Notice had been published for the time and in the manner as
provided by Ordinance No. 1258, as amended, the matter was heard by the City Planning
Commission and the Planning Commission recommended that a Special Use Permit Use
be granted to said property to permit the 175 foot tall communication tower along with 2
(two) prefabricated 4'4" x 2'4" equipment cabinets and 1 (one) 2'x2' protection cabinet
in a I-1 Industrial District
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNSEL OF THE
CITY OF WEST MEMPHIS ARKANSAS:
SECTION I: That the following described property, to wit: 4201 Petro Road,
being more particularly described as follows:
LEGAL DESCRIPTION
Being Lot 6 of the McCarley Industrial Park, 1St addition property being located within
the Northwest Quarter of the Southwest quarter of Section 10, Township 6 North, range 9
East as recorded in Plat Book 3, Page 227 at the Crittenden County Register's Office,
City of Marion, State of Arkansas, containing 88,209 square feet, or 2.025 acres, more or
less.
and the same hereby is granted a Special Use Permit permitting the usage of a 175 feet
tall communication tower along with 2 (two)4'4" x 2'4" equipment cabinets and 1 (one)
2'x2' protection cabinet in a I-1 Industrial District.
SECTION II: That all ordinances or parts of Ordinances in conflict herewith are
hereby repealed.
