A RESOLUTION APPROVING THE NEW PUBLIC HIGHWAY CROSSING
AGREEMENT AND FOR OTHER PURPOSES.
WHEREAS, an agreement with Union Pacific Railroad Company is necessary in order for the
South Loop Project to cross the railroad tracks operated by Union Pacific Railroad Company; and
WHEREAS, the City of West Memphis and Union Pacific Railroad Company have
negotiated an agreement entitled New Public Highway Crossing Agreement for the South Loop
Project to cross the railroad and a copy of said agreement has been presented to the West Memphis
City Council; and
WHEREAS, the West Memphis City Council finds that the New Public Highway Crossing
Agreement is in the best interests of the City of West Memphis and should be approved and the
Mayor and the City Clerk should be authorized to execute said agreement on behalf of the City of
West Memphis;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF WEST MEMPHIS, ARKANSAS, THAT the New Public Highway Crossing Agreement
between the City of West Memphis and Union Pacific Railroad Company is hereby approved and the
mayor and City Clerk are hereby authorized to execute said agreement on behalf of the City of West
Memphis.
