AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR
THE RELOCATION OF A 4" HIGH PRESSURE NATURAL GAS
LINE, AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Code Annotated Section 14-58-303 allows waiving of
competitive bidding in exceptional situations where such procedure is deemed not feasible
or practical; and
WHEREAS, the City of West Memphis and the Arkansas Highway and
Transportation Department have entered into an agreement to replace the bridge at West
Barton and Ten Mile Bayou; and
WHEREAS, as part of this agreement the City of West Memphis has agreed to be
responsible for the relocation of all utilities; and
WHEREAS, a 4" high pressure gas line owned by NorAm Energy Corporation
crosses the project site; and
WHEREAS, NorAm Energy Corporation has agreed to relocate their line at the
City's cost; and
WHEREAS, NorAm will contract the work out at an estimated cost of $24,166;
and
WHEREAS, the City of West Memphis will be provided with final invoices and
will be billed for the final construction cost;
NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS:
That competitive bidding be waived for the relocation of a 4" high pressure gas
line by NorAm Energy Corporation for an approximate cost of $24,166;

to reroute approximately 200 feet our 4"high pressure natural gas Iine, JM-23A, due to the
installation of a new sewer line. Thin u acceptable provided NorAm is reimbursed for the coat of
relocating the line. The estimate is as foAows;
