A RESOLUTION ACCEPTING THE ANNEXATION OF CERTAIN
TERRITORY TO THE CITY OF WEST MEMPHIS, ARKANSAS,
AND MAKING SAME A PART OF THE CITY OF WEST
MEMPHIS, ARKANSAS.

WHEREAS, a petition, as amended, was filed with the County Clerk of Crittenden
County, Arkansas, by the majority of the real estate owners of the hereinafter described
territory praying that said territory be annexed to and made a part of the City of West
Memphis, Arkansas; and
WHEREAS, on the 12th day of December, 1996, the County Court of Crittenden
County, Arkansas, found that the amended petition was signed by a majority of the total
number of real estate owners and the owners of more than one-half of the lands in the
affected area; that the allegations of the amended petition were sustained by the proof; that
an accurate plat or map of said territory had been filed with and made a part of said
amended petition; that proper notice had been given for the time and in the manner
prescribed by law, and that all things pertaining thereto had been done in the manner
prescribed by law, and that said lands and territory should be annexed to and made a part of
the City of West Memphis, Arkansas, subject to the acceptance of same by the City Council
of the City at the proper time, as provided by law; and
WHEREAS, upon the appeal of said Order of Annexation to the Circuit Court of
Crittenden County in consolidated cases numbered CIV-97-28 and CIV-97-29 the Circuit
Court entered Judgment dated August 25, 2000, affirming the judgment of the County
Court and granting the annexation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF WEST MEMPHIS, ARKANSAS, THAT:
ti n 1. The following described lands and territory contiguous to and
adjoining the City of West Memphis, Arkansas, be and the same is hereby accepted as
annexed to and made a part of the City of West Memphis, Arkansas:
An 835.3 acre tract of land lying in the fractional part of Sections 3, 4 & 10, T-6-N, R-8-E,
and all Section 33, less and except the SW'/4, T-7-N, R-8-E, Crittenden County, Arkansas
" and being more particularly described as follows:
Commencing at the NE corner of Section 10, T-6-N, R-8-E, thence South a distance of
1173.45 feet, thence West a distance of 1310.51 feet to the point-of-beginning, said point
being on the centerline of Airport Road (State Highway No. 118), point also being on the
existing city limits line as annexed by Ordinance 1336 dated 4/7/88, thence N00° 11'31"E a
distance of 1178 feet to its intersection with the south line of Section 3, thence continue
along the centerline of Airport Road, N00° 16'04"E a distance 5354.12 feet to a point on the
north line of Section 3, also the south line of Section 34, T-7-N, R-8-E thence West along
the south line of Section 34 a distance of 4034 feet more or less to the SE corner of Section
33,thence North along the east line of Section 33 a distance of 5280 feet more or less to the
N.E. corner of Section 33, thence West along the north line of Section 33 a distance of
4251 feet more or less to a point on the east line of Spanish Grant Survey No. 2932, thence
South along the east line of S.G. Survey No. 2932 a distance of 387 feet more or less to
the SE corner of said Survey No. 2932 thence West along the south line of Survey No.
2932 a distance of 1029 feet more or less to a point on the west line of Section 33, thence
South along the west line of Section 33 a distance of 2253 feet more or less to the NW
corner of the SW '/o of Section 33, thence along the north line of the SW '/a of Section 33 a
distance of 2640 feet more or less to the center of Section 33, thence South along the east
line of the SW '/4 of Section 33 a distance of 2640 feet more or less to a point on the south
line of Section 33, thence East along the south line of Section 33 a distance of 1488 feet
more or less to the NW corner of the N'/z NE'/a NE'/a of Section 4, T-6-N, R-8-E, thence
South a distance of 679 feet more or less to the SW corner of the N'/z NE'/a NE'/a of said
Section 4, thence East along the south line of the N'/z NE'/a NE'/a of said Section 4 a
distance of 1329 feet more or less to a point on the west line of Section 3, thence South
along the west line of Section 3 a distance of 2009 feet more or less to the SW corner of the
NW'/4 of Section 3, thence East along the south line of the NW'/4 of Section 3 a distance of
2578 feet more or less to the center of Section 3, thence South along the west line of the
SE'/4 of Section 3, a distance of 2649 feet, to the NW corner of the NE'/4 of Section 10
thence South along the west line of the NE'/4 of Section 10 a distance of 838 feet more or
less to its intersection with a point on the south right-of--way line of Interstate 40, also being
on the existing city limits as annexed by Ordinance 1336, thence along said right-of--way and
the existing city limits the following bearings and distances:
