A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO PROCEED WITH
NEGOTIATIONS FOR THE DISTRIBUTION OF THE FUNDS AND
PROPERTY OF THE CRITTENDEN COUNTY DRUG TASK FORCE.
WHEREAS, Crittenden County (the "County") and the City of
West Memphis (the "City") have provided law enforcement
officers, funds to match federal grants and property for the
joint law enforcement efforts known as the Crittenden County
Drug Task Force (CCDTF); and
WHEREAS, as of February 1, 1994, the federal grant funding
the CCDTF expired; and
WHEREAS, the City has elected as of February 1, 1994, to
continue its drug enforcement operations as a part of the West
Memphis Police Department; and
WHEREAS, during its operation the CCDTF has accumulated
project income from such sources as the forfeiture of
confiscated cash and vehicles and which project income should
be equitably divided between the City and the County; and
WHEREAS, the City has proposed that all project income as
of February 1, 1994, be divided by distributing to the City and
to the County a sum equal to their respective investments in
the CCDTF with all remaining Rinds to be divided equally
between the City and the County; and all cash or property
confiscated prior to February 1, 1994, and being subject to
forfeiture proceedings to be divided by distributing ten
percent of any amount awarded pursuant to forfeiture procedures
to the prosecuting attorney's office with all remaining funds,
up to $250,000 per forfeiture, divided equally between the City
and the County; all vehicles titled to the City or the County

shall be the property of the title holder; all other personal
property used by the CCDTF shall be divided as agreed upon by
the parties; and
WHEREAS, the City Council desires to proceed with an
equitable dissolution of the CCDTF assets as described above;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WEST MEMPHIS, ARKANSAS, THAT the City Attorney is
hereby authorized to negotiate the distribution of the CCDTF
assets as set out above and to take all necessary actions to
effectuate such distribution.
